<br />CITY OF NORTH OLMSTID <br />ORDINANCE N0. ,2 ~ J.-.z- <br />sY~~~~r~ <br />AN C~.DINANCE AUTHORIZING AND DIRECTING THE MAY~t AND <br />DIRECTOR OF PUBLIC SERVICES TO MAKE APPLICATION FOR A <br />FEDERAL CONSTRUCTION GRANT, ,UNDER THE PROVISIONS OF <br />SECTION 33 U.S.C. x.66 AND FOLL(7f~ING, WHICH GRANT TO BE <br />APPLIED TO THE C06T OF CONSTRUCTION OF THE SEWAGE TREAT- <br />M~IT PLANT INff'ROVET~ OF THE CI`1'Y OF NC~TH OLMSTED, AND <br />DECLARING AN EMERGENCY. <br />BE IT ORDAINED BY THE COUNCIL pf the City of North Olmsted, State of <br />Rio <br />Section 1: That the Mayor and Director of Public Service, be and are <br />hereby authorized and dir®cted~ to make application for a Federal Construction <br />Grant under the provisions of Section 33 U.S.C. 166 and followings the proceeds <br />of which grant, are to be applied to the cost of the construction of the Sewage <br />Treatment Plant ImFirovemsnt of the City of North Oltusted, and the Mayor and the <br />Director of Public Service, are further authorized to enter into an Agreement <br />with the Federal Government providing that if a Federal Grant be approved and <br />made for construction of a Sewage Treatment Plant Improvement of the City of <br />Plorth Olmsted, the City of-North Olmsted will agree to pay the remaining cost <br />of the improvement project, and further3 the City of North Olmsted will provide <br />proper and efficient operation and maintenance of the improvement project upon <br />completion of the construction of said improvement. <br />Section. 2: ~;n~ierefore, this Ordinance is declared to be an emergency <br />measure necessary for the immediate preservation of the pub7ac health, safety <br />ate. welfare of the City of North Olmsted, and such emergency exists by virtue <br />of the need of Federal assistance in the financing of the improvement., ~ahich <br />assistance is available to the municipalities such as the City of North Olmsted <br />under the terms and conditions set forth in Section 1 of this Ordinance, and <br />such assistance must be applied for immediately due to the limited source of <br />Federal Funds now available in the Budget for purposes as contemplated by <br />Section 1 of this Ordinance, all for the immediate preservation of the public <br />health, safety and welfare of the City. of North Olmsted. <br />Section 3: WHEREFORE, this (?rdinance shall take immediate effect from <br />and after its passages otherwise, at the earliest period allowed by law• <br />PASSED: ~/. l 9~5"~ <br /> <br />ATTEST: ~; <br />~' <br />CL K 0 ________ _-- <br />APPRCIVED: <br />~~ ~~ <br />~ <br /> <br />OF <br />~,. ~,,. <br />
