J ~ 7 AN ORDINANCE ESTABLISHING A VOLUNTEER FIREMEN~S DEPENDENTS FUND BOARD ~'D PROVIDING FCC THE ELECTION OF THE MEMBERS OF SUCH BOAftD WITH PROVISIONS TO ADI~IN- ISTEB THE FUND IN-ACCORDAATCE WITH SECTIONS 3310.01 TO 3310.24 INCLUSIVE OF THE REVISED CODE OF OHIO. WHEREAS, recently enacted Sections 3310.01 to 3310.24, inclusive:, of the Revised Code of Ohio, require the immediate establishment of a Volunteer Firements Dependents Fund Board to administer said fund. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIi. OF THE CITY OF NORTH OLMST~D:, STATE OF OHIO: Section 1. A. Volunteer Firements Dependents Fund Board is hereby estab~ishe-d for the administration bf a Volunteer Firemen~s Dependents-Fund as defined in Section 3310:01 of`the Revised Code of Ohio, in and for the City of North Olmsted, Ohio. Section 2. Said board shall have aut~c~rity to make all nec- essary rules and regulations for the handling and- processing of claims which may be submitted to them; and shall perform such other duties as may be necessary to carry out the provisions of"Sections 3310.01 to 3310.24, inclusive, of the Revised Code of Ohio. Section The Volunteer Firements Dependents Board shall consist off i.ve members who shall be chosen ~as follows:: (A) Tt~o members shall be'elected by the legislative authority of the City of North Olmsted, Ohi© (B) Two members~shall'be elected by the fire department of the City of North Olmsted, Ohio, (C) One member shall be elected by the board members elected in {A) and (}~~ above, and such member must be an elector of the munici- pality; but such member may not be a public employee, nor may"he be a member of the legislative authority or of the fire department. Section Election of board members set forth in (A) and (B) of Section 3 ereof, shall be held each year on the first Monday in December,~and the election of the board member set forth in (C) of said Section 3; shall be held on or before the second Monday of Secember of each year. Each board member shall serve for a one-year term commencing on January first next;; provided, that the initial board selected in 195? shall assume its duties immediately upon election. Section 5. The election of the two members of the board by the members of the fire department shall be held each year on the first Monday in December. The secretary of the board shall give notice of such elec- tion by posting it in a conspicuous place at the headquarters of the fire department and at eaoh"house composing such fire department. Between nine a.m. and nine p.m. on the day designated, each person in the depart- ment who by its rules is~designated a member thereof shall send by mail or otherwise, in writing; the names of two persons, members of the depart- ment, who are his choice. All votes cast at such election shall be counted and recorded by the board-which shall announce the result. The two members receiving the highest number of votes shall be members"of the board for the ensuing year. If any two persons receive a tie vote, it shall be decided by Iot or in and other way agreed upon by the persons for whom such tie vote was cast. Provided, that in the year 1957~the notice required herein shall be given by the clerk of the municipality. Section 6. In case of vacancies occurring on the board, they shall be filled in the manner provided for in section 741.05 of the Ohio Revised Code.
