ORDINANCE DETERMINING TO PROCEED WITH <br />v THS Il~PRQVEI-~NT OF FITCH ROAD FRt~+! <br />BUTTERNUT RIDGE ROAD TO SOUTH CITI bINE,. <br />By cO~sTRUCTIxG ADD -I~sTA~s~G A FI'PE <br />FOOT CDIJCRETE PU$bIC sIDEw~c ox BOTH <br />SIDES THEREOF. <br />HE IT ORDAINED BY THE COUNCIL OF THE CITS OF NORTH OL~ISTED, <br />STATE OF OHIO:: <br />Section That it is hereby det®rnined to proceed with the <br />improvementr- off- ,tra load fres~ Butternut Ridge Road to the south Gity <br />lin®, by constructing and installing a five foot concret® public side- <br />walk on both sides thereof, in accordance with R®solution No, 25.3, passed <br />September 3, 1957, and the petition of property ow-raers dsscrib ed in said <br />8esolution and in accordance with the plans, specificatioas~ estimates and <br />profiles heretofore approved and now on file in the office of the Director <br />of Public Service. <br />9~ection 2s, That all claims for damages resulting therefrom <br />shall be jud~e~a~ly-inquired into after the completion of the proposed <br />improvement, and the solicitor be, and he is hereby authorized and directed <br />to institute proceedings in a court of competent jurisdiction to inquire <br />into such claims, <br />S-ectio„~,~,_, That the cost of said improvement shall be assessed <br />by the foot- r•®nt-upon. the following described lots and leads, to-wit, all <br />lots and lands bounding and abutting upon:~the proposed improvement, which <br />said 1®ts acrd lands are hereby determin®d to be specially benefited by said <br />improvemaat~ and the cost of said improveffient shall include the expense of <br />preliminary and other surveys, of printing and publishing the notices, <br />resolutions and ordinances required the service of said notices, the cost of <br />constructions together with interest on notes or bonds issued in anticipation <br />of collection of deferred assessments and all other necessary expenditures. <br />S~ectian That the assessments so to be levied shall be paid <br />in ten ann~,a".~riasta lments, with interest not to exceed six per cent per <br />annum on deferred payments, provided that the owner of an _y property <br />assessed mays at his options pay such assessment in cash within thirty <br />days from and after the passage of the assessing ordinance, in xhich case <br />said assessment shall nc~t include any item of interest upon notes or bonds <br />to be issued ih anticipation of the collection of deferred installments <br />of assessments. <br />S:ectio~n 5.
