<br />RESOLUTION N0. 2559• <br />BY: Mr. Crider. <br />RESOLUTION DECLARING IT NECESSARY TO <br />IMPROVE COE AVENUE FROM ELM ROAD TO THE <br />NORTHERLY LINE OF HOME GARDENS ALLOTMENT <br />BY GRADING, DRAINING , CURBING AND PAVING <br />THE SAME.. <br />~ E IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLNiSTED, <br />STATE OF OHIO, THREE-FOURTHS OF ALL MEh'IBERS ELECTED THERETO CONCURRING: <br />Section 1. That it is deemed necessary and conducive to the <br />public health, cmnvenience, welfare and safety, by reason of the present <br />necessity of improving a dedic-~ted street, to improve Coe Avenue from <br />Elm Road to the northerly line of Home Gardens Allotment, by grading <br />draining, curbing and paving the same, between the points aforesaid. <br />Section 2. That the grade of said street shall be the grade <br />as shown on the plans and specifications for said improvement, which <br />said grade and elevations are hereby confirmed and established as the <br />grade of said street. <br />Section That the plans, specifiea.ti ons, estimates and <br />profiles ot~the proposed improvement heretofore prepared by the City <br />E rgineer and now filed in the office of the Director of Public Service <br />be and the same are hereby approved. <br />Section ~.. The whole cost of said improvement, less 1/50th <br />thereof and the cost of intersections, if any, shall be assessed ae- <br />cordir~g to the foot front upon the following described lots and lands, <br />to-wit: all lots and lands bounding and abutting upon both sides of <br />Coe Avenue from Elm Road to the northerly line Af Home Gardens Allotment, <br />in the City of North Olmsted, which said lots and la bds are hereby deter- <br />mined to be specially benefited by said improvement; and the cost of said <br />improvement shall include the expense of preliminary and other surveys, <br />of printing and publishing the notices, resolutions and ordinances re- <br />quired, the serving of said rotices, the cost of construction, together <br />~i~h in~erest on notes odr ends issued in a~ticp~~itures.collection of <br />e erre assessments an a other necessar ex <br />Section That the assessments so to be levied shall be paid <br />in ten ann~-insta lments, with interest not to exceed six per cent per <br />annum on deferred payments, provided that the owner of any property as- <br />sessed may, at his option, pay such assessment in cash within thirty <br />days from and after the passage of the assessing ordinances, in w#[ich <br />case said assessment shall not include any item of interest upon notes <br />or bonds to be issued in anticipation of the collection of deferred <br />installments of assessments. <br />Section 6. That notes or bonds of the City of North Olmsted <br />shall be issued in anticipation of the collection of assessments by <br />installments and in an amount equal thn~eto. The remainder of the <br />entire cost of said improvement not specially assessed shall be paid <br />out of the.
