SECTION l: That the proposed location of a point of access, <br />identified as Point E, to $rookpark Road (SR 17) at a point 1500 to <br />151.5 feet East of the intersection of Brookpark Road CSR 17) and <br />Lorain Road (SR 10}, be approved in accordance with the plan thereof <br />as reflected on the attached Schedule A which is made a part hereof, <br />and if said point of access to SR 17 is hereinafter approved by the <br />State Director of Highways, then the existing points of access identi- <br />fied as A, B, C, and D will be permanently closed and will not there- <br />aft~r be useable as points of ingress and egress to SR 17. <br />SECTION 2: That the design for the proposed acc®ss to ~Brookpark <br />Road shown as Point. E, be similar to that shown on Exhibit A and Exhib- <br />it B also attached hereto and made a part hereof. <br />SECTION 3: The developer, if authorized by the State Director <br />of Highways, to proceed to construct an access point at Point _E as <br />shown on attached Exhibit A, the developer is than required to so <br />construct said access point to effectively drain said area as not to <br />overload said Brookpark Road drainage system heretofore installed at <br />the time of the improvement of said Facility. <br />SECTION ~.: That the City of North Olmsted request and hereby <br />approves the pro used location of an access point to Brookpark Road <br />about 1500 to 15.5 feet Easterly of SR 10 and SR 17, as the most <br />effective and efficient way of controlling and directing traffic <br />from SR 10 anal SR 17, which Thoroughfares will be the principal <br />Thoroughfares used by vehicular traffic entering and leaving said <br />proposed shopping center. <br />SECTION 5: That the City of North Olmsted reaffirms all previous <br />commitments for and anderstands, that this Ordinance doss not void any <br />of its obligations for maintenance of this Facility, namely SR 17. <br />SECTION 6: If the Director of Highways hereinafter consents to <br />the modif cation of the liat3.ted access to Brookpark Road as contemplated <br />by this Ordinance, the Service Director is hereby authorized to issue <br />all necessary permits in accordance with the prop©s®d plans submitted <br />for the modification to the limited access of Highway SR l7 for the <br />construction of the new access point as set forth in Exhibit A and B <br />attached hereto. <br />SECTION 7: The Service Dir®ctor is directed to forward a copy <br />of this Ordinance, properly attested by the Clerk of this City, to the <br />Director of Highways notifying the director of Highways of the action <br />taken by this Council. <br />SECTION $: This Ordinance is hereby declared to be an emergency <br />measure necessary for the ilmnediate preservation of the public safety <br />and general welfare of the City of North Oln~ted and such emergency <br />exists by virtue of the n®cessitg of affording batter control and <br />direction of traffic to and from the proposed shopping center to be <br />erected adfacent to the intersection of SR 17 and SR 10 in the City of <br />North Oliasted, .and after a long study it has been determ»i.ned that the <br />construction of an access point to SR 17 approximately 1500 fast <br />Easterly of the intersection of SR 10 and SR 17, and the permanent <br />closing of-the four existing points of access at or near said inter- <br />section on the Southerly aids thereof, the City will be in a position <br />to more effectively control and direct traffic to and from said proposed <br />shopping canter, thereby pies®rving the public safety and general welfare <br />of the City of North 07.msted. <br />-2- <br /> <br />
