<br />WI~REAS, special assessments have been certified by the Auditor of
<br />the City of North Olmsted, Ohio, to the Auditor of Cuyahoga County for the
<br />preparation of detailed plans and specificat~.ons for a sanitary sewerage
<br />system in the City of North Olmsted, and
<br />WT~;REAS, it has been determined that the sanitarv sewer planning
<br />assessment placed on Permanent Parcel #237-21-lcb Mastick Road, owned by Mr,
<br />and Mrs. George F. and Fvangel..ine K. Bowman, was erroneously assessed and
<br />that Council determines it necessary to correct said error, to authorize the
<br />cancellation of said assessment, and to authorize the refund to Mr. and Mrs.
<br />Bowman of X2.60 for payments on said erroneous assessment already made. Said
<br />assessment, heretofore paid at the rate of X1.30 per year, is for the ,years
<br />1960 and 1961, and the assessment to be herein cancelled is from the year
<br />1962 through 1979, inclusive, or a total of 923.40,

<br />OLnsted, State of Ohio:
<br />Section i; That the Auditor of Cuyahoga County be and he i.s hereby
<br />authorized and directed to cancel for the years 1962 through 1979 inclusive,
<br />being assessments for the preparation of plans and specifications for a sani-
<br />tary sewerage system, which have been levied for the improvement of Mastick
<br />Road in the City of North 01.msted by the installation of a sanitary sewer
<br />system.
<br />Section 2: That thA Director of Finance is hereby authorized and
<br />directed to refund to Mr. and PTrs. George E. and Evangeline K. Bowman the
<br />sum of 92,60 for refund._of assessments h~retdfore~~psid on,-.Eermanent Parcel
<br />#237-21-46 for the ,years 1960 and 1y61, which. assessments have been deter-
<br />mined to be erroneously placed upon said Permanent Parcel PTumber,
<br />Section 3: That the Clerk is hereby directed to forward an attested
<br />copy of this Ordinance to the Auditor of Cuyahoga County, Ohio:
<br />Section 4: Wherefore, this Ordinance is hereby declared to be an
<br />emergency measure necessar~T for the preservation of the rublic peace, health,
<br />and welfare of the City of North Olmsted, and such emergency exists by virtue
<br />of the necessity of making arrangements for the immediate cancellation of said
<br />special assessments on Permanent Parcel No. 23?-21-l~6 Mastick Road for the
<br />preparation of detailed plans and specifications for a se~~erage system in said
<br />City, together with interest thereon f'or the years 19b2 through 1979 inclusive,
<br />Section ~: ~dherefore, this
<br />from and aft its passage, otherwise,
<br />Ordinance shall take immediate effect
<br />at the earliest period allowed by law.
