NORTH OLMSTED CHARTER 18 <br />Any provision of any ordinance, resolution or order disapproved by formal action of the <br />Planning Commission shall require atwo-thirds vote of all members of Council eligible <br />to vote for adoption or authorization. <br />SEC. 3. RECREATION COMMISSION. <br />The Recreation Commission shall consist of five (5) members, who shall serve <br />without compensation. The Mayor shall appoint the five members to the Commission, <br />two of whom shall be recommended by the Board of Education of the North Olmsted <br />School District. Of the two appointees recommended by said Board of Education, one <br />such appointee shall be a member of such Board of Education. Each of the appointees <br />shall be appointed for a term of five years, except that of the five members appointed for <br />the term beginning January 1, 1960, one shall be appointed for a term of one year, one <br />for a term of two years, one for a term of three years, one for a term of four years, <br />and one for a term of five years. In the event a Board of Education member, who has <br />been appointed to the Recreation Commission, ceases to be a member of the Board of <br />Education for any reason, then such appointee's membership on the Recreation Com- <br />mission shall terminate forthwith and said Board of Education shall recommend another <br />one of its members for appointment to fill such vacancy for the unexpired term. A <br />vacancy occurring during the term of any member of the Recreation Commission shall <br />be filled for the unexpired term in the manner authorized for an original appointment. <br />The terms of the present members of the Recreation Commission shall expire on <br />December 31, 1959. The powers and duties of the Recreation Commission shall be <br />provided by ordinance of Council. <br />SEC. 4. BOARD OF ZONING APPEALS. <br />(a) Membership. The Board of Zoning Appeals shall consist of five (5) members, <br />who shall be qualified electors of the municipality not holding other municipal office, <br />who shall be appointed by the Mayor, subject to approval by the majority of the elected <br />members of Council. The term of the present members of the Board shall terminate <br />on December 31, 1959. Those members appointed to this Board, shall be appointed for <br />a term of five (5) years, except that of the five appointed for the term beginning January <br />1, 1960, one shall be appointed for a term of one year, one for a term of two years, one <br />for a term of three years, one for a term of four years, and the fifth member for a full <br />term of five years. Any member of the Board of Zoning Appeals may be removed for <br />any cause by a vote of two-thirds of the elected members of Council. Any vacancies <br />occurring during the term of any member of the Board, shall be filled in a manner <br />authorized for an original appointment. <br />(b) Jurisdiction. The Board of Zoning Appeals shall have the power to hear and <br />decide appeals for exceptions to and variances in the application of ordinances, orders <br />or regulations of administrative officials or agencies governing zoning in the municipality. <br />The Board. of Zoning Appeals shall have such additional powers as may be granted to it <br />by ordinance of the municipality. Procedure before the Board of Zoning Appeals shall <br />be in accordance with the rules and regulations established by the Board of Zoning Appeals. <br /> <br />
