NORTH OLMSTED CHARTER 18 Any provision of any ordinance, resolution or order disapproved by formal action of the Planning Commission shall require atwo-thirds vote of all members of Council eligible to vote for adoption or authorization. SEC. 3. RECREATION COMMISSION. The Recreation Commission shall consist of five (5) members, who shall serve without compensation. The Mayor shall appoint the five members to the Commission, two of whom shall be recommended by the Board of Education of the North Olmsted School District. Of the two appointees recommended by said Board of Education, one such appointee shall be a member of such Board of Education. Each of the appointees shall be appointed for a term of five years, except that of the five members appointed for the term beginning January 1, 1960, one shall be appointed for a term of one year, one for a term of two years, one for a term of three years, one for a term of four years, and one for a term of five years. In the event a Board of Education member, who has been appointed to the Recreation Commission, ceases to be a member of the Board of Education for any reason, then such appointee's membership on the Recreation Com- mission shall terminate forthwith and said Board of Education shall recommend another one of its members for appointment to fill such vacancy for the unexpired term. A vacancy occurring during the term of any member of the Recreation Commission shall be filled for the unexpired term in the manner authorized for an original appointment. The terms of the present members of the Recreation Commission shall expire on December 31, 1959. The powers and duties of the Recreation Commission shall be provided by ordinance of Council. SEC. 4. BOARD OF ZONING APPEALS. (a) Membership. The Board of Zoning Appeals shall consist of five (5) members, who shall be qualified electors of the municipality not holding other municipal office, who shall be appointed by the Mayor, subject to approval by the majority of the elected members of Council. The term of the present members of the Board shall terminate on December 31, 1959. Those members appointed to this Board, shall be appointed for a term of five (5) years, except that of the five appointed for the term beginning January 1, 1960, one shall be appointed for a term of one year, one for a term of two years, one for a term of three years, one for a term of four years, and the fifth member for a full term of five years. Any member of the Board of Zoning Appeals may be removed for any cause by a vote of two-thirds of the elected members of Council. Any vacancies occurring during the term of any member of the Board, shall be filled in a manner authorized for an original appointment. (b) Jurisdiction. The Board of Zoning Appeals shall have the power to hear and decide appeals for exceptions to and variances in the application of ordinances, orders or regulations of administrative officials or agencies governing zoning in the municipality. The Board. of Zoning Appeals shall have such additional powers as may be granted to it by ordinance of the municipality. Procedure before the Board of Zoning Appeals shall be in accordance with the rules and regulations established by the Board of Zoning Appeals.
