WHEREAS, the water line in Walter Road in the City of North Olmsted presently terminates at a point North of Maple Ridge at or about the intersec- tion of Walter Road and Beech Lane, and WHEREAS, since the construction of the sanitary sewer in '~Jalter Road has interrupted, destroyed, or damaged the water supply for properties on Walter Road in the City of North Olmsted Northerly of tree present Northerly terminus of the water line serving properties in the City of North Olmsted now necessitating the extension of tiie public water supply to the residents on Walter Road not now served by a public supply, and ~~tEAS, the extension and construction of said public water supply line would be on the Westerly side of Walter Road at said point within the City limits of the City of Westlake, and WHEREAS, the City of Westlake in its desire to co-operate with the City of North Olmsted so that residents within the City of North Olmsted on the Easterly side of '.'alter Road at said point not now served by a public water supply could so secure the service of a public water supply, have agreed to permit the construction of a water line in the City of Westlake on Walter Road from the point where the existing public water supply line terminates in °~lalter Road at or near Beech Lane Northerly to the point where said water line termin- ates in Walter Road South of Westwood Road, and WI~REAS, said City of Westlake does not now intend to pay one-half (1/2) the cost of said construction nor to assess the same, as the abutting property owners in ?fltestlake do not wish to participate in said assessment, the City of Westlake will enact the necessary legislation to permit the con- struction of said water line and to provide that in the future when the abutt- ing properties to said proposed water line when constructed seek to have con- nections made thereto that said owners of said properties seeking said connec- tion will be required to pay to the City of '~destlake the necessary funds pro- portionate to the number of connections provided, upon the subdivision of said abutting lands, to the total cost of said construction which is determined to be equal to one-half (1/2) of the cost of said construction, and, when so collected, to reimburse the City of North Olmsted with one-half (1/2) the cost of the construction of said water line, and WHEREAS, the owners of property on the Easterly side of Walter Road between said points, residents of North Olmsted or owners oY property in North Olmsted, have petitioned to have said water line constructed and do agree to be assessed for one-half (1/2j of the total cost of said construction NOM, THERE~RF, BE IT RESUL"VED by the Council of the City of North Olmsted, State of Ohio: Section 1: That the City Engineer be and he is riereby authorized to prepare the necessary plans and specifications for the construction of a water main 5.n Walter Road with appurtenances thereto from a point at or near the in- tersection of `:~Talter Road and "Beech Lane Northerly to the present terminus of the water line in Walter Road in the City of Westlake Southerly from Westwood Avenue about One Thousand One Hundred Fifty Feet (1,150) and when so designed and approved by Council, to secure the approval of said plans and specifica- tions of the i^Jater Department of the City of C"leveland for said construction.
