<br />CITY OF NORTH OLMSTED <br />RES'~LllTION N0. b1 X06 <br />~, J ~G~ ~ <br />RESOLUTION AUTHOR?IZTNG THE DIRECTOR OF PUBLIC SERVICE TO <br />PURCHASE 17Zt FEET OF 2!~" CONCRETE PIPE, AND DECLARING AN <br />EMERGENCY. <br />Wf~REAS, The Lorain Mutual Investment Company has agreed, as a con- <br />dition to the development of Michael Avenue proposed in the developers pro- <br />posed subdivision, to install 1711 feet of 21~" pipe at the Southerly end of <br />Georgette Avenue to the stub for said connection placed in accordance with <br />the plans and specifications f'or the development of Michael Avenue proposed, <br />which it is expected when so constructed will relieve substantially the <br />flooded conditions of Georgette Avenue W®sterly of Pi~ichael Avenue proposed, <br />Nt?~nT, 2'HEREFORE, BE 1T RESOLVED by the Council of the Gity of North <br />Olmsted, State of Ohio: <br />Section 1: That the Director of Public Service ~ and he is hereby <br />authorized to purchase 1711 feet of 2!~" concrete storm sewer pipe for installa- <br />tion at the Southerly end of Georgette Avenue to the culvert involved in the <br />development and improvement of Michael Avenue proposed at the Brookpark storm <br />sewer, apart of the over-all improvement plan of Michael Avenue proposed. <br />That said purchase of said pipe is the City's share of said improvement of <br />Georgette Avenue and T~iichael Avenue proposed, which the developer agrees to <br />undertake and will undertake the necessary furnishing of labor and material <br />for the laying of said pipe in accordance with the plans and specifications <br />on file with the Director of Public Service and the City Engineer of said <br />City. <br />Section 2: Tidherefore, this resolution is hereby declared to be an <br />emergency measure necessary for the public health, safety and welfare, and such <br />emergency exists by virtue of the immediate necessity of permitting the con- <br />tractor to proceed with the construction of Michael Avenue proposed while <br />weather permits. <br />Section 3: T~Therefore, this resolution shall take immediate effect <br />from and after its passage, otherwise, at the earliest period allowed by law. <br />-~ <br />PASSED : ~ /~ <br />ATTEST: <br />~........_. _..J <br />t 5E HALL, CLERK OF CO IL BRUCE MAC DONALD, PRESTO OF COUNC <br />APPROVED: <br />r <br />---~ ,~ ~ <br />~~~~,,, <br />,..~atic..~ - ~ <br />PA J.
