CITY OF NORTH OLMSTED <br />~~ <br />i-t.`~SC7L4iJTTON NO. 61 ~~ <br />RESf~LUTTON Rr~LF~ASING BOND OF' FODOR SUBDIVISION ON <br />BURNS ROAD SUBLOTS AND DF,GLARIIdG AN EMERGENCY. <br />WHEREAS, heretofore Fodor Subdivision, developing certain lots en <br />Burns Road had, in compliance with the ordinances of the City of North Olmsted, <br />posted a cash bond to insure the City that the required improvements to Burns <br />Road in the development of said sublots of Fodor Subdivision would be com- <br />pleted, and <br />WHEREAS, the City Engineer has reported to Council that the work <br />required of the Fodor Subdivision on Burns Road has been completed in con- <br />formity with the ordinances of said City, <br />NOW, THG1,REFCRE, BF IT R?;SOLVED by the Council of the City of North <br />Olmsted, State of Ohio: <br />Section 1: That the Director of Finance and Director of Public <br />Service 13e and are hereby authorized to release the cash deposits heretofore <br />made by the Fodor Subdivision for the improvement of Burns Road for sublots <br />of the developer abutting thereon as said construction required under the <br />ordinances of the City have been completed and in conformity with said <br />ordinances. <br />Section 2: That this resolution is hereby determined to be an <br />emergency measure necessary for the preservation of the public peace, health, and <br />safety of said City and such emergency exists by virtue of the necessity of now <br />releasing the cash bond deposit heretofore made by the Fodor Subdivision <br />guaranteeing the improvement of ,3urns Road abutting lots being improved by the <br />developer located thereon and w~ich have been reported completed in conformity <br />with the ordinances of` said City to be entitling the developer for a refund of <br />the amount of deposits less any properly deducted expenses incident to said <br />~.mprovement. <br />Section ,3: Wherefore, this resolution shall take immediate effect <br />from and after its passage, otherwise, at the earliest period allowed bq taw. <br />PASSED: ~`~-~ d / <br />ATTEST: <br />-. <br />~~ <br />APPROVED: <br />PAUL G U, M OR <br /> <br />y~'~ <br />~-~ -6~ <br />
