CITY OF NORTH OLMSTED <br />RFSt1LUTI0N N0. bl - ~d <br /> <br />RESOLUTION ACCEJ'-'TNG AND APrRC1VLNG THE I3~IPROVF;- <br />MENT PLANS OF TIC; LORAIN MtJTIIAL INVESTMENT CtiM- <br />PANY AND VARCAN RFAL2Y COMPANY FOR THE DF,VELOP- <br />MENT OF MICI3AEL AVEt~tUE PROPOSED, AND DECLARING <br />AN EMERGFNCX. <br />W?~REAS, heretofore the plat for the development of i~:ichael Avenue <br />proposed within said City, prepared for and on behalf of the developer, the <br />Lorain Mutual Investment Company and/or Varean Realty Company, often referred <br />to as the Michael Varady Subdivision, has been accepted for record purposes <br />only by the Council of this City, and the conditions imposed upon the develop- <br />er for the acceptance of" said plat for record purposes only having been met, <br />and <br />'yJHEREAS, the developer, in order to proceed with the developt~nt of <br />said proposed subdivision, is required under the ordinances of this City to <br />submit the necessary improvement plans for the improvement of i~lichael Avenue <br />proposed, which plans have been submitted to the City Engineer, P7.anning <br />Commission, and Council, and found to meet the requirements of the ordinances <br />and resolutions of this City, <br />NOW, TI~REFOItE, I3E IT Ith:~SOLVED by the Council of the City of North <br />Olmsted,, Cuyahoga County, State of Ohio: <br />Section l: The improvement plans for the development of Michael <br />Avenue proposed in the Lorain Mutual Investment Company's subdivision, some- <br />times referred to as Varady Realty Subdivision or Michael Varady Subdivision, <br />have been reported to Council by the City Engineer as meeting the requirements <br />of the ordinances of this City, and Council having studied the earns find that <br />the improvement plans do so comply with the requirements of the ordinances and <br />resolutions of this City, said improvement plans for the development of Michael <br />Avenue proposed are hereby approved. <br />Section 2: This resolution is hereby declared to be an emergency <br />' measure necessary for the preservation of the public health, safety and welfare <br />~" of this City and such emergency exists by virtue of the necessity of immediately <br />approving the improvement plans referred to in Section 1 hereof, permitting the <br />developer to proceed with the construction of Michael Avenue proposed at the <br />earliest possible time that weather permits. <br />Section 3: 6Jherefore, this resolution shall take immediate effect <br />from and after its passage, otherwise, at the earliest period allowed by law. <br />PASSED: /~2- - E~ f <br />ATTEST ~, ,, <br />,- .• n <br />SE , CL~_ K OF CO C BR c ONA , P ~ 0 0 <br />APPROVED: <br />~ } <br />.: ~ ~ 4 <br />r `~'~..' <br />PA J.
