CITY OF NORTH OLN6STED By ORDIPIANCE N0. 61 - f 9~ AN ORDINANCE A~TTHORIZING AND DIRECTING THE CANCELLATION OF SPECIAL ASSffiSMENTS OH PERMAZiENT PARCEL N0. 235-2o-g.~ LOIIIS DRIVE, BEING AN ASSESSME[~'P FORTHE PREPARATION OF DETAILED PLANS, SPECIFICATIONS F{?R A SEWERAGE SYSTEM AND WATER. ASSESSMENT IN THE CITY OF NORTH OLINSTr,D, AND DECLARING AN EMERGENCY WHEREAS, heretofore, special assessments have been certified by the Auditor of the City of North Olmsted, Ohio, to the Auditor of Cuyahoga County for the preparation of detailed plans and specifications for a sewerage system in the City of North Olmsted, and a water assessment for the improvement of Louis Drive by the construction of a water ma3.n in the City of North Olmsted, and WHER7'e:AS, Jerome E. and Anne C. Kilbane, have paid the suns of ~95•~ on the Sewer Assessment covering the years 1962 through 1979 inclusive; and the sum of X185.76 on the Water Assessment covering the years 1962 through 1964, which assessments have beenaertified and levied for the improvement of Louis Drive North Olmsted, Ohio. NOW, TF3EREFORE, BE IT ORDAINED by the Council of the City of North Olmsted, State of Ohio: Section is That the Auditor of Cuyahoga County be and he is hereby authorized and directed to cancel for the years 1862 through 1979 inclusive on the Sewer Assessment the sum of $85.40, and the sum of $185.76 on the Water As~ess- ment covering the years 1962 through 1864, which assessments have been levied for the improvement of Louis Drive by the installation of a sewerage system and water main. Section 2: That the Treasurer of the City of North Olmsted is hereby authorized and directed to receive payment in advance on .said Water Assessments for the years 1962 through 1964 inclusive in the sum of ~~$5-~6 and the sum of ~95•~ on the Sewer Assessments for the years 1962 through 1979 inclusive for a total of $281.16 on both assessments. Section 3: That the Clerk is hereby directed to forward an attested copy of this Ordinance to the Auditor of Cuyahoga County, Ohio. Section 4s Wherefore, this Ordinance is hereby declared to be an emergency measure necessary for the preservation of the public peace, health and welfare of the City of North Olmsted, and such emergency e~tists by virtue of the necessity of making arrangements for the immediate cancellation of said special assessments on Permanent Parcel No. 235-20-53, levied for the preparation of detailed plans and specifications for a sewerage system in said city and for a water main, together with interest thereon for the years 1962 through 1979 on said sewer assessments and for the years 1962 through 1964 on said water assessments, which have been paid. Section 5: Wherefore, this Ordinance shall take immediate effect from and after its passage, otherwise, at the earliest period allowed by law.
