RESOLUTION DECLARING 1T NECESSARY TO 17KPROVE DECKER ROAD FROM THE SOUTHERLY LINE QF SUB-LO-~ 39!6 S0t1THERLY TO 30UTHERN AVENUE BY CONST~ttICTING AND INSTALLING `i'HEREIId A STORM SEWEEt AND DECLARING AN EMERGENCY. WHEREAS, the owners of at least sixty per cent (60~) of the front footage of property on Decker Road from the southerly line of sub-lot 3~6 to Southern Avenue petitioned, in writing, for the improvement of said street by constructing and installing therein a storm sewer, and WHEREAS, the Engineer has reported the validity of said signatures and is representing the .owners of 60;6 or more of the front footage of prop- erty abutting on said proposed improvement, NC1HT, THEREFCIRE, :BE IT RESaL~TED by the Council of the City of North Olmsted, State of Ohio: Section 1: That it is necessary to improve Deck®r Road from a point on th® southerly lot line of sub-lot 3y6 southerly to Southern Avenue by constructing and installing therein a storm sewer. Section 2: That the ~~du of said street as improved shall be the existing grade as shaven by the Engin~eerta plans az~d profiles, which are made a part hereof. In that the said grade therein established is herein eonfirraed as the established grade. Section 3: That the plans, specifications, estiaw,tes and profiles of the proposed improvement heretofore prepared by the Engineer and nox on rile in the office of the Director of Public Service be, and the same are hereby approvied. Section !~: That the entire cost of said improvement shall be assessed by the front foot upon the following described lots and lands to- wit: all lots and lands bounding and abutting upon the proposed imrprov®ment, Which said lots and lands gre hereby determined to be specifically benefitted by said improvement; and the cost of said improvement shall include the ex- pense of the prelirninazq and other serveys and of printing and publishing the notices, resolutions and ordinances required and the serving of said notices, the cost of csonstruction together with interest an notes and bonds issued in anticipation of the collection of deferred assessments and all other necessary expenditures. Section ~: That the assessments to be so levied shall be paid in ten {10) annual instalLaents with interest on deferred payments at the earns rate as shall be borne by the bonds to be issued in anticipation of the col- lection thereof; provided that the owner of any property'asseaaed may, at his option, pay such assessment in cash within thirty (3©) days after the passage of the assessing ordinance. Section 6: That bands of the City of North Olmsted shall be issued is anticipation of the collection of assessments by installments and i.n an amount equal thereto, and notes of said City shall be issued i.n anticipation of the issue of said bonds. Section 7: This resolution is hereby determined to be an emergency measure necessary for the preservation of the public health, safety and wel- fare and such ®mergency exists by virtue of the necessity of making said im- provement to Decker Road by the construction and installing therein of a storm sewer, permitting the construction and occupancy of homes proposed to be constructed on lands abutting said proposed improvement. Section 8: This resolution shall take affect and be in force from and after the earliest period allowed by law.
