LOiA _~1 l~OADS AND ;Td TI?~ ~flLTI'H SID T~~'?I'~FOF, ANll DIRIaCT1N~' `l'? r~~ CONS%~LTTNrT '~i'1GT_~T"'~'{ TO r;~,VI>E PLlII'~IS A ti~~ SP ~'CIFICATI^NS Arr~ ~~Lr~J:"TIO~'S TTi"R~FORE. ~III;y~RFAS, it has been determined by Council, upon the recorr~nendation of the Director of Public service, that it would be in the best interests of the City that the proposed tunneling under Lorain Road at Dover Road from the South side to the North side be eliminated, and that the lateral sewer on the Sout;zerl~r side of Dover Road at said intersection extend Northerly only to tie So~ztherly boundary o'' the Aten (Broton~s Drive-In) property located on the Southeast corner of Loran and Dover Roads, and to extend ';aster_Ly along; said Southerly line and Northeasterly along the easterly line thereof to the rear of the premises of the Suburban Plurribin~~, and I-Ieating Company located on the Sout'~?east corner of LucYdale and Lorain toads, to proceed 'easterly along the rear property lines of said corner properties to the point where it would eventually tie in to the trunk line at or near Saint R.ichard's Church and on the Southerly side thereof. The Director of Public Service reported to Council that the property owners in the area of the proposed relocation of the lateral sewer have agreed to furnish easements therefore, and, as Council deter:~ines t;aat said proposed relocation .s for the best interests of the City, P?~'~;n7~ Tt?r"~''r~~.ftiF, rS'~:~ TT RTS`~L';~'D by the Council o~~ the City of North `~lmsted~ State of Ohio: Section 1: That "loyd Browne ~, Associates, Consulting 'ngineers be and are hereby authorized to make the necessary revised plans and the specifications and elevations for the prop-Nosed relocation of the lateral sewer serving Dover Load and other properties r?,asterhr t:~ereof in accordance with the sketch heretofore sub- mitted to them by the Director of Public Service who, together with the Pisld nTineer of said Consultant Firm, have determined that said proposed relocation would eliminate the necessity of tunneling under Lorain Road at the intersection of Dover I?oad, and that Council does hereby approve tiie proposed relocation of said sewer, and upon sub- mission of the plans and desi_Mns for said relocation will approve the same when sub- mitted Section 2: `i"riat the right-of-°.~a~T un¢ineer, Harrtr Kenard, employed by Floyd 3rowne ~~~ Associates and the C~.ty for the purposes of obtaining the necessary easements for the installation of the sanitary sewer laterals is hereby authorized to proceed to obtain the necessary easements for the proposed relocation of the laterals now proposed to extend along the Southerly boundary of properties fronting on Lorain Road }~,asterly of Dover 'woad to a point where. it will connect ?with the trunk line South of Saint ~:ichard's property. Section 3: '.~Jherefore, this resolution is determined to be an emergency measure necessar~r for t ie public nea:Lt~z, safety and welfare, and such emeri:;ency exist: by virtue of immediately preparing the necessar~* plans, s~±ecifications and elevations for tine proposed relocation of said 'over lateral sewer in order to avoid tunneling under Lorain Road at ,'oaer 1Zoad. Section ~.: ~Iheref_ore, this resolution shall take i;^~taediats effect from and after its passage, otherwise, at the earliest period allowed by law.
