<br />WHEREAS, Council has determined that at the time of the enactment
<br />of Resolution 61 - lEt7 Council had neglected to insert the designated free-
<br />holders appointed to report the estimated assessments of the costs to be
<br />charged on lots and lands for the construction of sanitary sewers which are
<br />described in legislation heretofore enacted, and in the construction of
<br />said sanitary sewers, and for the mast expedient handling of said construc-
<br />tion, the Council has heretofore divided that portion of the City in which
<br />sanitary sewers are to be constructed into various contracts designated as
<br />fol].oxs: Contract !~, Contract 1tA, Contract 5, Contract 6, and Contract 8.
<br />It is determined that said resolution should be repealed and re-enacted
<br />designating the three freeholders appointed by Council to estimate the
<br />assessment of such costs on the lots and lands charged therewith as set
<br />forth in the various ordinances designating the lots and lands to be charged
<br />therewith,
<br />NOW, THERF.~FORE, BE TT RESOLVED by the Council of the City of North
<br />Olmsted, State of Ohio:
<br />Section 1: Resolution Number 61 - 1La.7, enacted August 3, 1961, is
<br />hereby repealed.
<br />Section 2: Council hereby designates John Gregg, Josephy Sheehy,
<br />axx~ George Barton, twee disinterested freeholders of the City of North
<br />Olmsted, be and they are hereby appointed to a board to estimate the assess-
<br />ment of such costs on the lots and lands to be charged therewith as set
<br />forth in Ordinance Number 61-2$ enacted February 21, 1961, as amended by
<br />Ordinance Number 61-62 enacted April !~, 1961; Ordinance Number 61-?0 enacted
<br />April 1$, 1961; Ordinance Number 6i-29 enacted February 21, 1961 as amended
<br />by0rdinance Number 61-63 enacted April !~, I961; Ordinance Number b1-1.52
<br />enacted August 1~, 1961; Ordinance Number 61-1.53 enacted August 15, 1961; to
<br />imq~rove the streets therein named by constructing therein a sanitary s®wer
<br />in proportion as nearly as may be to the benefits it may result from the im-
<br />provement to the several lots or parcels of land so assessed and to report
<br />to this Council the estimated assessment.
<br />Section 3: tiJherefore, this resolution is hereby declared to be an
<br />.~:-
<br />emergency measure necessary for the immediate preservat_on of the publie.~ealth,
<br />peace, safety, and welfare of the City of North Olmsted, and such emergency
<br />exists by virtue of the necessity of determining the assessment for the im-
<br />provement of the lots and lands described in Section 1 hereof, permitting here-
<br />by the issuance and sale of bonds for the finance of cost of said constructs on
<br />at the earliest possible date.
<br />Section L.t: wherefore, this resolution shall take immediate effect
<br />from and after its passage, otherwise, at the earliest period allowed by law.
