~_. <br />CITY OF NORTH OLI~'TED <br />ORDINANCE N0. 61 ~~; <br />BY ~ .~ r <br />_--~ <br />AN ORDINANCE E~ ER~-+.INING TO PROC:~'ED `udITH Tim IT~II'RC~VE,~'+~ENT C}F <br />CANTERBURY ROAD FROM LOR.AIN ROAD NORTHERLY TO TIi; NORTHERLY <br />CITY LIMITS BY CONSTRUCTING THEREIN A FIVE {5) FOOT CONCRETE <br />PUBLIC SIDEWALK ON BOTH SIDES THEREOF WHERE NOT ALREADY IN- <br />STALLED, AND DECLARING AN ~' GENCY. <br />W'+ AS, heretofore, Council, by Resolution No. 61-126 enacted <br />June 20, 1961, authorized the Service Director to advertise for bids for <br />the furnishing of labor and material for the construction of a five (5) <br />foot concrete public sidewalk from Lorain Road northerly to the Nca~therly <br />City Limits where not already installed, and <br />WHEREAS, pursuant to said resolution, said advertisement was <br />placed in the Plain Dealer on June 2~. and July 1, and pursuant to the <br />bids submitted, the Board of Control of said City -warded the contract <br />__ <br />or said walks to Jaek Boss, Contractor, and which contract was duly <br />executed by the City August 15, 1961, <br />NOW, T ~RFFORE, BE IT bRDAINED by the Council of the City of North <br />Olmsted, State of Ohio, there-fourths of ail members elected thereto concurring: <br />Section l: That it is hereby determined to proceed with the improve- <br />ment of Canterbury Road from Lorain Road northerly to the Northerly City Limits <br />by constructing therein a five (5) foot concrete public sidewalk on both sides <br />thereof where not already installed in accordance with Resolution No. b1-91 en- <br />acted May 3, 1961, and Resolution No. 61-126 enacted June 20, 1961; and, iri ac- <br />cordance with the plans, specifications, estimates and profiles heretofore ap- <br />proved and on file in the office of tree Director of Public Service. <br />Section 2: That all claims for damages resulting therefrom shall be <br />judicially inquired into before commencing the proposed iurprov®ment and the <br />Mayor be, and he is hereby authorized and directed to institut® proceedings in <br />a court of competent jurisdiction to inquire into such claims, if any, <br />Section 3: That the whole cost of said improvement, less at least <br />one-fiftieth (1/50) thereof, the cost of culverting and all i37tersectionz~ shall <br />be assessed by the front foot upon the following described lots and lands, to-wit: <br />All lots and lands bounding and abutting on the proposed <br />improvement in accordance with the plans,speeifieationS, <br />estimates and profiles, which lots and lands are hereby <br />determined to be specifically benefitted by said improvement; <br />and the cost of said improvement shall include, with the exceptions hereinabt~ee <br />noted, the expense of the preliminary and other surveys, and all printing and <br />publishing of notices, resolutions, and ordinances required, and the service of <br />said notices, the cost of construction together with interest on notes and bonds <br />issued in anticipation of the col]e ction of deferred assessments, and all other <br />necessary expenditures. That the assessments so to be levied are to be paid in <br />ten (10) annual installments with interest on deferred payments at the same rate <br />as shall be borne by the bonds to be issued in anticipation thereof; provided <br />that the owner of any property assessed may, at his option, pay such assessment <br />in cash within thirty (30) days after the passage of the assessing ordinance. <br />Section !~; That bonds of the City of North Olmsted shall be issued <br />in anticipation of the collection of assessments by installments and in an <br />amount equal thereto; and notes of said City shall be issued in anticipation <br />of the levying of such assessments afid the levying of such bonds. <br />Section 5: That the City Engineer be and he is hereby directed to <br />prepare and file with Council a tentative assessment showing the amount to be <br />charged on each lot or parcel of land to be assessed. <br />
