<br />AN ORDINANCE AUT~?ORIZING ANU DIRECTING THE CANGELLATION OF
<br />SPECIAL ASSESSMCNTS ON PERMANENT PARC~'L NO. 235-11-1$ AND
<br />P~'RI441ANE'NT PARC~~ NO. 235-11-19, 547.1a llECKER ROAD WATER MAIN,
<br />STORM 5F`~TER, AND STR"ET PAVING, IN TiiF CITY OF NORTH OLMSTED,
<br />ANll DECLARING AN ~ ,:RGENCY.
<br />WHEREAS, heretofore, special assessments have been certified by the
<br />Auditor of the City of North Olmsted, Ohio, to the Auditor of Cuyahoga County
<br />for the improvement of Decker Road Water Main, :Storm Sewer, and Street Paving
<br />in the City of North Olmsted by constructing therein a water main, storm sewer,
<br />and street paving, and
<br />WHEREAS, Frank].ui O. Lytle and Gustav R. Bartling have paid the sum
<br />of 3bl.yb on the storm sewer, ~ld7.ttli on the water main, and ~55~.52 on the
<br />street paving, together with accrued interest thereon, Levied against Permanent
<br />Parcel No. 235-11-18 and Permanent Parcel No. 235-11-1y on llecker Road in the
<br />City of North O.tsnsted, Ohio,
<br />NOW, THEREFORE, BE I`f ORDAINED by the Council of the City of North
<br />Olmsted, State of Ohio:
<br />Section l: That the Auditor of Cuyahoga County be and pie is hereby
<br />authorized and directed to cancel all future assessments beginning with the
<br />year 1961 and continuing through the year 196$, inclusive on the street paving,
<br />and beginning with the year lybl and continuing through the year 1Qbb inclusive
<br />on the storm sewer, and beginning with the year lybl and continuing through the
<br />year lgbt~ inclusive on the water main which have been certified and levied for
<br />the improvement of :Decker Road by constructing therein a storm sewer, water
<br />main, and street paving.
<br />Section 2: That the Treasurer of the City of North Olmsted is hereby
<br />authorized and directed to receive payment in fu1.1 with interest on such assess-
<br />ments for the storm sewer beginning with the year 1961 through ly6b inclusive,
<br />the water main beginning with the year lybl through 19b1t inclusive, and the
<br />street paving beginning with the year 1y61 through 1y68 inclusive, amounting to
<br />~137.l~l~ on the water main, 3ti1.96 on the storm sewer, and ~~55.52 on the street
<br />paving, for a total of ~1,72l~.92.
<br />Section 3: That t~:~e Clerk is hereby directed to forward an attested
<br />copy of this ordinance to the Auditor of Cuyahoga County, Ohio.
<br />Section ~: inlherefore, this ordinance is hereby declared to be an
<br />emergency measure necessary for the preservation of the public peace and welfare
<br />of the City of North O.Lmsted, and such emergency exists by virtue of the necessity
<br />of making arrangements far th® immediate cancellation of special assessments on
<br />Permanent Parcel No. 235-11-1$ and Permanent Parcel No. 235-11-i9 levied for the
<br />improvement of Decker Road in said City, by constructing therein a storm sewer,
<br />water main, and street paving, which special assessments together with interest
<br />thereon for the storm sewer run from the~year 1961 through 1966 inclusive, the
<br />water main from the year 19b1 through 19b!} inclusive, and the street paving from
<br />the year 1961 through 19b8 inclusive, have been paid in full.
<br />SectioTi 5: Wherefore, this ordinance shall take immediate effect from
<br />and after its passage, otherwise, at the earliest period allowed by law.
