<br />(a} ~o ©fficer, attorney at law, agent, clerk, guardian,
<br />executor, ex®cutrix, admnistrata~r, ad~niiu.stratrix, trustee,
<br />assgne® in insolvency, receiver, offi.c®r of a lodge or sub-
<br />ordinate body of a fratsraal. or m~ttu81 benefit socie'~y, ser-
<br />vant, or emplo~*ee of a person,.: exoept apprentieess a~ persons
<br />under eighteen qes~ of age, shall e~exxle or convert to his
<br />own use, fraudulantl~r #.~~e or wake aw~-y with, or secrete wa.th
<br />intent to embe~xle ox' cornrert to his own use aaa~thi~ of valu~a
<br />w~.ich comes into hiss possessiQ#~ by virtue of has election,
<br />appointment, or er-~aioyment thereto.
<br />(b) No person, being elected or appointed to an office of
<br />public trust or profit, or an agent or er+~loyee of such officer
<br />or of aboard shall:.embezzle or aanvert to his own use, or cones
<br />teal with such intent, anything of value that comes into his
<br />possession by virtue of such office or employment,
<br />(c) No person snail embexxle an evidence of debt, otiable
<br />by delivery only and actually executed bat not a~,sl.ivered or iss-
<br />ued as a valid instrument.
<br />Section 9: PENALTY.
<br />(a) ~thoever violat®s Section 1 or Section 7 of this ord-
<br />finance shall be fined .not snore than one hundred dollars (~l(%'l, OQ } ~
<br />or imprisoned not more than thirty (30} dare, ar both.
<br />{b} Whoever violates Sections 2 to 6 inclusive of this
<br />ardinana®, shall be fin®d not-more than. three hundred dollars
<br />C~3~.~}~ ar imprisoned not amore than ninety (90) days, or
<br />bot~, if the value of such thi ,property, or instrument is
<br />less than sixty dollars {60.00.
<br />(c) Whoever violates Section 8 of this ordinance, shall be
<br />fined not more than t~,ree hundred dollars {*300.00), or im-
<br />prisoned not. more than ninety {9Q} days, ar both, if the total
<br />value of such thing, property, or instrument emberled yr con-
<br />versed in the same continuous err~-loyment or term. of office,.
<br />whether embexxled or converted at one tim~a or art different
<br />times within three years prior to the inception of the giros-
<br />station, is less than sixty dollars 060.00).
<br />Section 10: As used in this ordinance ,for the violation oi' which there
<br />is provided a penalty or forfeiture, unless the context otherwise requires,
<br />s,~yrthing of value" includes:
<br />(a} Roney, bank bills or notes, Un~.ted Status '~reasu~^~r notes,
<br />and other bills, bonds, or notes issued by lawful authority and
<br />intended to pass and circulate as money;
<br />(b) Goods and chettels;
<br />(c) Promissory nat$s, bills of exchange,, orders, drafts,.
<br />warrants, checks, car bonds given for the payment of money;
<br />(d) Receipts given for the payment of mpney or other property;
<br />(e} Rights in action;
<br />{f) Things w~ich savor of_the realty and are, at the .time they.
<br />are tee} apart of the freehold, whether they are of the suw-
<br />stance or produoe thereof ~sr affixed theretcafalthough there .may
<br />be no interval between the severing and taking away;
<br />(g} Every other thing of value.
