CITY OF NORTH OLMSTED RESOLUTION N0. 61 - q,~j By ~• .,._..,..~~ RESOLUTION AUTHORIZING THE EXTENSION OF SANITARY LATERAL SL'G~EFt. LINKS FROM THE CURB LAWN TO THE PROPERTY LINE OF IMPROVED PROPERTIES TO BE SERVID WITH SANITARY SEWERS, AND DECLARING AN EMERGENCY WHEREAS, heretofore, Council of the City of North Olmsted authorized the preparation of plans, designs, elevations and specifications for the con- struction of a sanitary sewage system for the City of North Olmsted by Floyd G. Browne ~ Associates, Consulting E~igineers of Marion, Ohio, which firm, pursuant to said authorization and agreement made with the City, prepared detailed plans, specifications, elevations and estimates for the construction of a sanitary sewage system which at the time called for the extension of lateral sewers within said system, to extend to the curb lawn only, and ~rJH~, upon the submission of said detailed plans, specifications, elevations and estimates, Council did, heretofore, approve the same with the limitation and provision that the lateral sewers extend only to the curb lawn, and WHEREAS, this Council having considered the problems arising from the limitation of the extension of said lateral sewers as heretofore provided and from many discussions with interested owners of residences to be served by said sewer system, ,determine it more practical, equitable, and in the interests of the general welfaxe of the municipality as a whole, to authorize the extension of the lateral sewers from the curb lawn to the property line of all improved properties within the area of the City presently planned to be served with the sanitary swage system confining the proposed extension to the property line to only improved properties, and contemplate providing for legislation for the connecting of properties within said sewage area to hereafter improve said premises by the construction of appurtenances thereto requiring sanitary sewer service so that said properties hereinafter connecting to said sewer, pay their proportionate share of said lateral sewers. NOW, `1'FIENEFORE, BE IT RESOLVED by the Council of the City of .North Olmsted, State of Ohio: Section l: That Council hereby authorizes the preparation by Floyd G. Browne & Associates., Consulting Engineers, of detailed plans and the modifica- tion of plans insofar as is necessary to make provision for the extension of lateral sewers in those areas to be served with sanitary sewage syste~: by extend- ing said lateral sewers as now designed from the curb lawn to the prroperty line and authorize and direct the Director of Public Service to immediately negotiate with the contractors now constructing lateral sewers in Contracts 4 and 5, to so extend the lateral sewers provided for in said contracts from the curb lawn to the property line by contracting for said additional cost with said .contractor at the most economical rate under the terms of the contract now in existence between the contractor and the City. Section 2: `Phat the Consulting Engineers and the Director of ~'ta.blic Service are hereby required and directed to .make the provisions for the extension of the lateral sewers from the curb lawn to the property line of improved properties ,~ as an addenda to any contract for the construction of lateral sewers in the process of bid or already bid and the contract therefor not let, in order to carry out the terms and provisions of Section 1 hereof and in the future bids for the constructio of any lateral sewers to provide for the extension of lateral sewers to the property line. Section 3: Wherefore, this Resolution is hereby declared to be an emergency measure and such emergency exists by virtue of the necessity of immediatel providing for the authorized extension of lateral sewers in Contracts 4 and 5 now under construction, thereby minimizing the necessity of keeping the streets under construction for an excessive period of time and for the further reason of reducing
