CITY OF NORTH OLI~STED <br />O~ZDZNANC% N0. 61 - y~. <br />By ~:~~!/Lt~v <br />AN ORDINANCE AUTHORIZING THE DIi~CTOR OF PUBLIC SEP~JIC <br />TO ADVII~TISE T'OR BIDS i4~OR TNCIP1~.c~ATIOPv OF THE GARBAGE <br />AND RUBBISH OF' THIS CITY AND T~'OR THE DIRECTOR OF PUBLIC <br />SERVICE AND THE; MAYOR TO ~'NTER INTO A CONTRACT WITH THE <br />LOWEST AND BEST BIDDER AND DECLARING AN EMERGENCY. <br />BE IT ORDAIIV~..=D by the Council of the City of North Olmsted, G~rahoga <br />County, State of Ohio: <br />Section l: That the Director of Public Service be and ha is hereby <br />authorized and directed to advertise requesting the submission of bids to in- <br />cinerate all garbage and rubbish generated within this City and now collected <br />by the Department of Public Service, and the Mayor and said Director be and <br />they are hereby authorized and directed to enter into a contract providing <br />for payment by the City for such incineration with the Lowest and best bidder <br />as hereiafter~approved by the Board of Control of this City. <br />Section 2: That the Director of Finance be and he is hereby auth- <br />orized to affix his certificate to such contract that moneys to meet such <br />contract during t~se year 1961 are now available or in the process of collection <br />and free from ar~p previous encumberance. <br />Section 3: That the Director of Public Service be and he is hereby <br />authorized and directed to prepare specification on which bids shalt be sub- <br />mitted. The specifications stall. contain provisions permitting the trucks of <br />the City to be emptied at such times as wiL1 not interfere with the normal <br />operation of the collection service, permitting a single collection for bath <br />garbage and rubbish, requiring acceptance of all garbage and rubbish from <br />within the Gity for a period of fifteen years, requiring the location of the <br />incinerator to be designated, requiring a general description of the incin- <br />erator and specified whether it is an existing incinerator with. additions <br />and improvement, if any, or will be newly constructed (if additions or im- <br />provements are to be made or new construction is to take place, than the <br />date for beginning of such additions, improvements or construction must be <br />specified), submission of evidence that the operation of the incinerator <br />will be under control of an individual, partnership or corporation exper- <br />ienced in the operation of an incinerator, permitting the bid to specify a <br />price which may increase or decrease through the term of the contract, per- <br />mitting the City to audit the weights and records of the incinerator as they <br />relate to garbage and rubbish of the City and requiring the submission of a <br />certified checl; or bidders bond in th.e amount of x¢2,500 as evidence that if <br />the bid is awarded a contract wi11 be entered into in accordance with the <br />specifications and requirin submission of evidence prior to entering into <br />the contract but a:Cter submission of the bids that the bidder has been awarded <br />contatacts for incineration which are sufficient to permit the construction of <br />the incinerator together with such additional provisions and requirements <br />consistent herewith as are necessary to protect and preserve the public health, <br />safety and welfare and will permit the collection and disposal of garbage of <br />this City to be carried out in an effic~snt arm sanitary manner. <br />Section !~s This ordinance is hereby declared to be an emergency <br />measure necessary for the i.~nmediate preservation of the pub3.ic health, safety <br />and welfare of said City and for the further reason that the City now has no <br />permanent method of disposal of the garbage and rubbish of this Gity and it is <br />necessary to make irL~ediate arrangerients therefor so as to eliminate a potential <br />hazard to the health of s_ts residents; wherefore, this ordinance sha11 'oe in <br />full force and effect fro~~i and immediately after its passage and approval by <br />the layora~.~ ~,~,3 ~ /6-6i <br />PASSED: ~~6~ ? __ _~ <br />n,`T"Ti;S <br />ise .ail, Clerk of Council ~ :Croce I~Iac onald, President of Council <br />~'~ ~ 4 <br />~;;~. ,° ~ `' ';.~ ~ ~~--~ ~~.--'" Paul J.
