CITY OF I~RTH OLMSTED <br />RESOLUTION N0. 61- ~~ <br />~~ ~~ <br />RESOLUTION AUTHORIZING THE RELEASE OF SIDEWALE BOND FEE FOSTE'I3 <br />BY NORTH OL1+~STED ESTATE`S IN THE PRINCIPLE PEI+TAL SUM OF ~.:OOO.OO~ AND <br />DECLARING AN ENCY <br />WHL~REAS, the Director of Public Service and the City &~gineer have <br />heretofore reported to Council. that the uncompleted sidewalks required to be <br />constructed by N®rth Olaeated Eetatta in its subdivision ha~re been comrtru~sted <br />and completed in confo~naity with the plans and specifications of the developer <br />and in accordance with the ordinances of this City, and that <br />THEREFORE, the bond posted b9 the developer should be released <br /> <br />NOW, THER~EFOF~, BE Ifi RESOLVED by the Council of the City of North <br />Olmsted, State of Ohio: <br />Section l: Gouncil hereby authorises and directs that the penal Mond <br />heretofore posted by North Olmsted Estates for the completion of public sidewalks <br />in its subdivision, which bond is identified as in the principle sromt of X1,000.00 <br />with the Aetna Casualty and Securities Company, No. 2 S 67537, bs released, as the <br />developer has satisfactorily completed the construction of the required public <br />sidewalks in accordance with the developer's plans and specifications and in <br />accordance with the ordinances of this City. <br />Section 2: Wherefore, this resolution is hereby deter~irytd to be an <br />emergency measure necessary for the preservation of the public w~slfare of the <br />City and such emergency exists by virtue of releasing the penal pravsioae of <br />the bond referred to in Section 1 hereof as the developer has cc~plied with the <br />ordinances of this City and with the plena and specifications heretofore approved <br />by Council at the time the improvement plans for the North Olmsted Estates Subdivisio: <br />were approved. <br />Section 3: Wherefore, this resolution shall take i+as~ediate effect from <br />and after its passage, otherwise, at the earliest period alloxed bg lax. <br />r <br />PASSED s ~',- / ~ l <br />A <br />aye , er o ounc <br />ruse v , e e o Duna <br />APPROVED: <br />APR 2 0 196'. <br />
