- 2 - <br />condition after any construction, maintenance, operation, repair, replacement, <br />alteration, changing the size of or removal of said sewer. Said right of way <br />and easement sha}1 be over, through and across the northerly nine (9) feet of <br />each of said parcels described in Exhibit'"A"for a permanent easement for the <br />purposes above set forth with an additional ten (10) feet of temporary easement <br />to the south of and parallel to said nine (9) foot strip with the right to enter <br />upon said additional ten (10) foot strip with all necessary machinery, equipment <br />and labor force for the purpose of locating and constructing said sewer and upon <br />the completion of said construction, the city's right to said temporary ten (10) <br />foot easement shall terminate. <br />Section 2: That the Mayor be and he is hereby authorized and directed <br />to cause written notice of the passage of this Resolution to be given to the <br />owners of or persons in possession of or persons having an interest of record <br />in the above described real estate or to their authorized agents and said notice <br />shall be served according to law by a person to be designated for that purpose <br />by the Mayor and to mdse return of such service in the manner provided by law. <br />Section This Resolution is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public health and safety. <br />Therefore this Resolution shall be in full force and effect from and immediately <br />after its passage and approval by the Mayor. ,~ <br />~{ <br />7 ~ , r A~~~-+sC.. <br />Passed e ~ ~~~ 196 / President of Council <br />Approy~d <br />11 J j/~J~ /(/Jj <br />~e9Ll <br />yqr <br />is <br />-' <br />t C erk of Council <br /> <br />
