CITY OF NORTH OLMSTED ORDINANCE No. 62 - ~ ©c~ ___ AN ORDINANCE ACCEPTING THE WARRANTY DEED OF MINNIE SCHMELLER FOR CERTAIN LAND AT THE INTERSEGTIUN OF GREAT NORTHERN BOULEVARD AND KENNEDY RIDGE ROAD FOR RI(~iT OF WAY PURPOSES ON THE TERMS AND CON- DTTIONS HEREIN PROVIDED, AND DECLARING AN EMERGEN CY. WHEREAS, the Director of Public Service by authority of Resolution No. 62-151, has reported to the Council that the land described in said Resolution owned by Minnie Schmeller, widow and unmarred, can be acquired by a conveyance. of said land to the City of North Olmsted upon condition that the City pay to Minnie Schmeller the sum of $300.00 and that the City assume and pay for the cost of a title guarantee, the cost of revenue stamps for said deed and the expense of f fling the same for record, and in addition thereto, a gas meter located on the parcel to be conveyed be re-located without ex- pense to Minnie Schmeller so that said meter will continue without interruption to furnish gas service to the property of Robert Frank Schmeller on the northwest corner of said intersection. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North Olmsted, State of Ohio: Section 1: That the City of North Olmsted accept from Minnie Schmeller her warranty deed conveying to the City of North Olmsted the parcel of land described in Resolution No. 62-151 for the use of the City in widening the right of way at the intersection of Kennedy Ridge Road and Great Northern Boulevard at the northeast corner thereof. Section Z: That the City of North Olmsted pay (a) to Minnie Schmeller the sum of $300.00 net and that it assume and pay (b) the cost of revenue stamps on the deed and the cost of recording the same; (c) taxes, general and special for the year 1962; and <d) and in addition thereto that the developer re-locate the gas meter on said parcel sa that said gas service will continue uninterrup~~d to service the pro- perty of Robert Frank Schmeller on the northwest earner of said intersection. Section 3: That the Director of Finance be and he is hereby authorized to pay to Minnie Schmeller, upon instructions of the Director of Law, the sum of $300.00 and charge the same to the Permanent Improvement Fund and that he pay on the approval of the Director of Law the cost of a title guarantee, revenue stamps for the deed and taxes, general and special, for the year 1962 on the above referred to property and charge said items to the General Fund. Section 4: That this Ordinance is hereby declared to be an emergency measure necessary for the preservation of the public
