<br />CITY OF NORTH OLMSTED <br />ORDINANCB No. 62 ' / <br />~ ; . <br />By - ~-z--~- ~- <br />AN ORTTTNANCB ASSESSING THE COST AND EXPENSE OF <br />IMPROVING CANTERBURY ROAD IN THE CITY OP NORTH <br />OLMSTED BY THE CONSTRUCTION t)F SIT?EWALKS <br />THEREIN, ANTS DECLARING AN EMERGENCY. <br />WHEREAS, the Engineer of this City has <br />certified that the improvement of Canterbury Road in the <br />City of North Olmsted, Ohio, by the construction of side- <br />walks where such sidewalksc were not constructed by the <br />abutting property owners as directed in the notices served <br />upon or published for such owners as set forth in Resolution <br />No. 61-91, adopted by this Council on May 3, 1961, have been <br />completed pursuant to specifications and contract and said <br />improvements have been accepted by this Council and the Director <br />of Public Service; and <br />WHEREAS, the Engineer of this city on May 1, <br />1961, filed with the Clerk of this Council and with the Director <br />of Public Service tentative assessments of the cost and expense <br />of installing said sidewalks, and <br />WHEREAS, notice of the filing of such tenta- <br />tive assessments was given according to law and no objections <br />have been filed with respect to such tentative assessments. <br />NOW, THEREFORE, BE IT ORDAINED by the Council <br />of the City of North Olmsted, State of Ohio: <br />Section l: That the assessment: of the cost and ex- <br />pense of improving Canterbury Road by constructing certain <br />sidewalks thereon pursuant to Resolution No. 61-91 adopted by <br />this Council on May 3, 1961, which sidewalks were not con- <br />structed by the property owners whose respective properties <br />abut on such street, as directed in the notice served upon or <br />published for each such property owner and which sidewalks are <br />referred to and described in the list of tentative assessments <br />heretof ore filed with the Clerk of Council and the Director <br />of Public Service, amounting in the aggregate to Fifteen <br />Thousand Doliars 015,000.00) as reported to this Council on <br />May 1, 1961, by the Engineer of this City, notice of the filing <br />of which assessments has been given as required by law, be and <br />the same is hereby ratified, adopted and confirmed; that <br />there be and is hereby levied and assessed upon the lots and <br />lands bounding and abutting upon said improvement, the several <br />amounts reported as aforesaid, which assessments, together <br />with the description of said lots and lands, are now on file <br />and have been since May 1, 1961 in the office of the Clerk of <br />thisCouncil and the office of the Director of Public Service <br />of this City, and which assessments are in proportion to the <br />special benef its resulting f roan said improvement and are not <br />in excess of any statutory limitation. <br />Section 2: That the total assessment against each <br />lot or parcel of land shall be payable in cash within thirty <br />(30) days from and after the passage of this Ordinance, or, <br />
