CITY OF NORTH OLMSTED <br />RESOLUTION No. 62~ <br />By G ''~~y~yrl <br />A RESOLUTION ACCEPTING THE IIuIPROVEMENT PLAi~TS OF <br />CANDLELIGHT SUBDIVISION, AND DECLARING AN EMERGENCY. <br />WHEREAS, Candlelight Subdivision has hereto- <br />f ore submitted its subdivision plat which. this Council has accepted <br />for record purposes only; and <br />WHEREAS, the developer has now submitted <br />plans for the required improvements within the areas designated <br />for street purposes, which. plans the City Engineer has approved <br />subject to certain conditions; and <br />WHEREAS, a strip of land in the area desig- <br />nated as Hawkins Avenue, proposed (shown in shade on the improve- <br />ment drawings and being approximately 25 feet by 250 feet) is not <br />owned by the developer of Candlelight Subdivision but is owned by <br />a LeRoy Harris; and <br />WHEREAS, the developer has agreed that such <br />strip will be dedicated and improved by virtue of the developer's <br />contract with said LeRoy Harris for the installation over said strip <br />of twelve (12) feet concrete pavement and curbing and thirty (30) <br />feet of s ix <6 ) foot by ten (10) ~f oot box culvert ; and <br />WHEREAS, the developer has agreed to post a <br />surety bond in the amount of $13,500.00 as set by the City Engineer <br />to assure performance of said condition. <br />NOW, THEREFORE, BE IT RESOL'JED by the Council <br />of the City of North Olmsted, State of Ohio: <br />Section 1: That the Council does hereby approve the <br />improvement plans of Candlelight Subdivisian as submitted but <br />subject to the following conditions, to-wit: That the developer <br />post a bond in the amount of X613,500.00 to assure the installation <br />of a twelve (12) foot strip of concrete pavement and curbing and <br />thirty feet of six C6) foot by ten (10) foot box culvert over a <br />strip of Hawkins Avenue, proposed Cshown in shade on the improve- <br />ment drawing and being; approximately twenty-five (25) feet by <br />two hundred fifty C250) feet) which is presently in the name of <br />LeRoy Harris and to assure the dedication of said. strip. <br />Section 2: That this Resolution is hereby determined to <br />be an emergency measure necessary for the preservation of the <br />public health, safety and welfare, such emergency existing by <br />virtue of the necessity of giving immediate apprc-val to said im- <br />provement plans so that the orderly development of the Gity may <br />proceed as rapidly as possible; ~'VHEREFtJi2E, this Resolution shall <br />take effect and be in force immediately upon its passage, otherwise, <br />at the earliest period allowed by law. <br />PASSED: ~ .~ 7 //~'~~ <br />Bruce Ma.c onald, President <br />of Council <br />ATTES • <br />Louise Hall, Clerk o ouncii <br /> <br />r i r ;_ <br />
