G,vu~-c c <br />~~--lP <br />CITY OF NORTH OLb1STED <br />.~ <br />ORL?Iiv'ANCE No. 62 ~~ <br />By C~ ~~. <br />AN ORDINANCE AI'~'OINTING A BO,1RU TO REPORT ESTII~LITED <br />ASSESShENTS OF CERTAIN STRLE;TS AND LANDS TO PAY THE <br />COST OF CONSTRUCTING SANITARY SEI~TERS THEREIN, RE- <br />PEALIN z RESOLUT~:ON No. 61-163, ENACTED AUGUST 21, <br />19b1, AN~3 DECLARING AN E?~IERGENCY. <br />W't1EsZE.AS, this Council by Resolution No. 61-147 <br />enacted August 21, 1961, appointed therein three freeholders <br />to estimate assessments to be charted on lots and lands for <br />the construction of sanitary sewers anc~ to report said estimated <br />assessments to the Council; and <br />WHER~'1S, it has been called to the attention <br />of Council that the freeholders therein named own property in <br />the areas to be assessed and Council deems it advisable to <br />appoint to said estimating hoard three disinterested freeholders <br />who own no lots or lands in the area to be assessed and that by <br />reason thereof Resolution No. 62-1b3 should be repealed; and <br />~t~~3EKF.AS, Council also wishes to determine that <br />reasonable compensation should be paid to the members of such <br />board for their services. <br />NO~~i, THEREFORE, BE IT OR}AINED by the Council <br />of the City of North Olmsted, State of Ohio: <br />Section 1: That Resolution No. 61-163 enacted August 21, <br />19b1, be and the same is k~iereby repealed. <br />Section 2: That the Council hereby appoints John Vest, <br />DeWitt Henney and Robert Burghardt, three disinterested freehoi:aers <br />of the City of North Olmsted, as the members of a special board <br />to estimate the assessments to be charged against certain lots <br />and lands as set forth in Ordinance loo. 61-28, enacted February 21, <br />1961, as amended by Ordinance No. 61-62, enacted April 4, 1961; <br />:ordinance No. 61-70, enacted April 1F~, 1961, Ordinance No. 61-29, <br />enacted February 21, 1961., as amended by Ordinance avo. 61-63, en- <br />acted April 4, 1961, Jrdinance No. 61-152, enacted August 15, 161, <br />Ordinance No. 61-153, enacted August 15, 1961 for the improve- <br />ment of streets therein named by the construction of a sanitary <br />sewer; said assessments to be estimated in proportion as nearly <br />as may be to the benefits that may result to the improvement of <br />ttze ]_ots and lanr_"~s to be so assessed and to report saki estimated <br />assessments to this ':o~~nci1. <br />Section 3: ?'~?at Council hereby authorizes the payment <br />by the ?director of Finance out of the Sewer Assessment Fund to <br />John West, DeWitt ~-jenziey and. Robert ~3L~rghardt, the members of <br />the estimating board, compensation at a rate of $2.75 r~er hour. <br />Section 4: 'T'hat this Ordinance is hereby deter,r:ined <br />to be an emergency measure necessary for the preservation of the <br />public welfare and by vi.rtt.ie of the necess.i ty~ of providi.n~ an <br />estim~atina board as an integral Hart of the sanitary sewer pro- <br />gram of the City at the earliest poss?ble date. <br />
