CITY OF NORTH OLMSTEU <br />ORDINANCE No. 62 -° ~_ <br />a,. >r a e <br />AN ORDTNANCE AUTHORIZING THE MAYOR OF THE CITY <br />OF NORTH OLMSTED TO SIGN A CONTRACT FOR THE <br />PURCHASE OF CERTAIN PROPERTY, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, Council, in order to enlarge the <br />recreational facilities of this City, deems it advisable to <br />purchase certain real property now owned by James A. Denton <br />and E11a May Denton which is adjoining to and can he used to <br />enlarge Claque Road Playground. <br />NOW, 'T'HEREFORE, BE IT ORDAINED by the <br />Council of the City of Iv'orth Olmsted, State of Ohio: <br />Section 1: That Council deems it advantageous to the <br />City of North Olmsted and conducive to public health, safety, <br />convenience and welfare to purchase property adjoining Claque <br />Road Playground; said property being described as fo1J_ows: <br />Situated in the City of North Olmsted, County of <br />Cuyahoga and. State of Ohio, and known as being part <br />of Original Dover Township Lot No. 39 and bounded <br />and described as follows: <br />Beginning on the titi'esterly line of land conveyed to <br />James W, and Toola Lekas by 'deed dated July 7, 1960 <br />and recorded in Volume 9965, Page 76 of Cuyahoga <br />County Records, at its intersection with the Northerly <br />line of Ohio Shores Construction Corporation Sub- <br />division :No. 1, as shown by the recorded plat in <br />Volume 165 of Maps, Page 9 of Cuyahoga County Records; <br />thence Northerly along the Westerly line of land so <br />conveyed, and along the Northerly prolongation thereof, <br />to the Southerly line of land. conveyed to Join Koelewyn <br />by Treed dated August 7, 1906 and recorded in Volume <br />1045, Page 204 of Cuyahoga County Records; thence <br />ta~esterly along the Southerly line of land so conveyed, <br />about 378.32 feet to an inner corner thereof; thence <br />Southerly along an Easterly line of land so conveyed to <br />,John Koelewyn, 197.85 feet to the Northerly line of Ohio <br />Shores Construction Corporation Subdivision No. 2, as <br />shown by the recorded plat in Volume 165 of Maps, Page <br />10 of Cuyahoga Count~j Records; thence Easterly along <br />the Northerly line of Ohio Shores Construction Corpora- <br />tion Subdivision i~`o. 2 and Subdivision No. 1, 380.23 feet <br />to the place of beginning, be the same more or Less, but <br />subject to all legal highways. <br />from the record title holder, James A. Denton and Ella May nenton, <br />for the sum of One Thousand 'dollars ($1,000.00? cash plus the <br />cost of title guarantee in the amount of $1,000.00, revenue <br />stamps on the deed in the amount of $1.10 and subject to taxes <br />and special assessments for the last half of the year 1.961, and <br />thereafter, which. the City arees to assume and one-half of the <br />co:5t of an escrow fee, all as more fully set forth in the attached <br />sales agreement which is incarporated herein by reference as if <br />ft211y re-written and made a part hereof. <br />
