C3AREAU <br />MAYOR <br />To the Council of the City of North Olmsted <br />North Olmsted, Ohio <br />June 15, 1962 <br />Dear Sirs: <br />Ordinance No. 62-88 is hereby returned with my veto for the <br />following reason: <br />Firstly, I question this as to whether it could be legally <br />enforced. <br />Secondly, even though it could be enforced, it is my contention <br />that these duties are being designated to the wrong body. <br />We need only to check the Charter of the City of North Olmsted, <br />Article VII, Section 2, Paragraphs (b) and (d), which spells <br />out very definitely and completely the duties of a Planning <br />Commission; and nowhere contained therein do I see they have <br />the power to regulate buildings because of their design or <br />material, or location, only insofar as public buildings of <br />the municipality are concerned. <br />The duties, as prescribed in the Reviled Code of the State of <br />Ohio, 713.02, are substantially the same. <br />It is my belief that no Legislative Body should issue ordinances <br />as a retardent measure, unless it is found that we at least have <br />a possibility of having them upheld in the Courts.
