CITY OF NORTH OLMSTED <br />ORDI~tiTANCE No. 62 -- ~' ~ <br /> <br />AN ORDINAi~tCE T7IRECTING l~<~-iE BUILDINCz GOMMISSIt)NER <br />TO REFER Tv THE PLANNING COi~1MISSION ALL APPLICA- <br />TIONS FOR BUILDING PERMITS AGAINST tn~:ICH A <br />WRITTEN PRC7TEST O(t OBJECTION HAS BEEN FILED, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Building Commissioner, from <br />time to time, receives protests or objections to the issuance <br />of building permits for structures which because of their <br />design, material or location would substantially impair the <br />values of neighboringa, properties; and <br />WHEREAS, it is the intention of Council <br />that a decision in such cases should be made by the City <br />Planninn Commission. <br />NOW, THEREFORE, BE IT OR:pAINEP, by the <br />Council of the City of North Olmsted, State of Ohio: <br />Section is That when the Building Commissioner re- <br />ceives a written complaint or protest to the issuance of a <br />building permit, before said permit has been issued, he shall <br />refer the matter to the City Planning Commission for considera- <br />tion; the decision of the Planning Commission shall be made <br />only after the applicant and any complainants have been given <br />an opportunity to be heard by the Commission; the decision <br />of the Planning Commission shall be final and binding upon all <br />persons concerned therewith, except that nothing contained <br />herein shall limit in any way the powers hereinbefore vested <br />by ordinances, resolutions or statutes in the Zoning Board of <br />Appeals or otherwise conferred by law. <br />Section 2: That in deciding whether a building per- <br />mit shall be issued in such cases, the Planning Commission shall <br />consider: <br />Ca) Whether or not the proposed structure is of <br />such design, material or location as to substantially <br />impair the value of neighboring properties; and <br />(b) Whether the denial of a building permit Evould <br />unreasonably impede the normal development of the pro- <br />perty to be built upon. <br />Section 3: That the Planning Commission shall render <br />its decision within thirty (3C?) days after the reference of <br />the matter to it by the Building Commissioner and if no de- <br />cision is rendered on or before the expiration of the thirty <br />days, the ,permit shall be issued. <br />Section 4: This Ordinance is determined to be an <br />emergency measure necessary for the preservation of the public <br />peace, health, safety and welfare because it is essential in <br /> <br />
