<br />CITY OF NORTH OL~ISTEU <br />OR~INt1.~VCE No. 62 --~=t---- <br />ray _ !~1~- - n~-~ <br />__ '~~' <br />AN ORDINANCE VACATINu MIDVALE AVEi~UE FROM TIDE <br />EASTERLY LINE OF BURNS ROA.B TO THE EASTERLY <br />TERMINUS OF SAT1~ i~IIDVALE AVEiWE, AND DECL:~2ING <br />AN EMERGENCY. <br />~~, <br />W~1EI~E.AS, Carl. E. Swick and Flora I. Swick, <br />Husband, and Wife, ,john B. Rodwan and Phyllis N. Rodwan, Husband <br />and ~~'Vife, and The North Olmsted Board of Education, all of the <br />three abutting property owners on that portion of Midvale Avenue <br />in the City of North Olmsted from the easterly line of ~3urns <br />Road to the easterly terminus of said Midvale Avenue, have filed <br />with the Council their written consents to the vacating of such <br />portion of ?~--Midvale Avenue by the Council; and <br />WHEREAS, Council is satisfied that there is <br />good cause for vacating said portion of Midvale Avenue and that <br />such vacation will not be detrimental to the general welfare and <br />the public interest. <br />NOVV, THEREFORE, t3E IT OR')AINEa~ by the Council <br />of the City of North Olmsted, State of Ohio: <br />Section 1: That that portion of ?b4idvale Avenue from the <br />easterly line of ~iurns Road to the easterly terminus of ~~Iidvale <br />Avenue, further described by metes and bounds as follows: <br />Situated in the City of North Olmsted, County of Cuyahoga <br />and State of Ohio, and known as being part of Original <br />Olmsted Township Lot No. 19, Tract No. 6 and being bounded <br />and described as follows: <br />Beginning at the intersection of the Easterly line of Burns <br />Road 50.00 feet wide with the Northerly line of Midvale <br />Avenue 50.00 feet wide, as shown on the plat of Butternut <br />Ridge Subdivision recorded in Vol. 111, Page 6 of the Cuyahoga <br />County Records; thence East 247.25 feet to a point in the <br />Easterly line of said subdivision; thence South along said <br />Easterly line of said subdivision 50.00 feet to a point; <br />thence West 247.25 feet to the Easterly line of Burns Road; <br />thence North 50.00 feet to the place of beginning, be the <br />same more or less, but subject to all legal highways. <br />be and the same is hereby vacated. <br />Section 2: That this Ordinance is deterr;rined to be an <br />emergency measure necessary for the immediate preservation of the <br />public peace, safety, health and welf are by virtue of the urgent <br />necessity to eliminate responsibility and liability of the City <br />for the section of ~~~lidvale Avenue hereinabove vacated, and this <br />Ordinance shall, therefore, go into immediate effect upon the <br />passage thereof. <br />]PASSED : ~ {~~~! ~'H ~ <br />f <br />~ ~ <br />Bruce MacDonald, President <br />of Council <br /> <br /> <br />ATTE, <br />L uise Hall , C1 erk of Council <br />
