_~ CITY OF NORTH OLMSTED ORDINANCE No. 62 '~' ~~ By ~~ AN ORDINANCE ACCEPTING T~iE INrPROVEMENT PLANS OF SOUTH RITJGE HOMES SUBDIVISION, AND DECLARING AN EMERGENCY. °" WHEREAS, the plat of the South Ridge Homes Subdivision has previously been accepted by this Council for record purposes only; and WHEREAS, the developer has submitted plans for the required improvements within the areas designated for street purposes; and WHEREAS, the City of North Olmsted has re- quired that the developer install in Windsor Drive from the east line of Sublot No. 61 to the west line of Sublot No. 44 Ca dis- tance of 1278 feet) a twenty-four C24) inch sanitary sewer. pipe which can be utilized as an integral part of the sanitary sewer system of the City of North Olmsted instead of a ten (10) inch sanitary sewer pipe which would ordinarily be required of a de- veloper; and WHEREAS, the City of North Olmsted has agreed to reimburse the developer at a rate of $8.24 per foot for the installation of the larger pipe at a total cost of $10,530.72; and WHEREAS, said reimbursement is to be made by the City of North Olmsted to the developer after the construct~.on of said line has been completed and accepted by the City of North Olmsted. NOW, TI~EREFORE, BE IT ORDATNEI) by the Council of the City of North Olmsted, State of Ohio: Section 1: _ That the Council does hereby approve the improvement plans heretofore submitted for the South Ridge Homes Subdivision subject to the following conditions, to-wit: (a) That the developer construct and install in Windsor Drive from the east line of Sublot No. 61 to the west line of Sublot No. 44 Ca distance of 1278 feet) a twenty-four C24) inch sanitary sewer line instead of the usual ten C10) inch pipe ordinarily required so that said twenty-four <24) inch line can be utilized by the City of North Olmsted as part of its sanitary sewerage collection system when this area of the City is sewered. (b) That the developer post a bond with the Finance Director in an amount set by the City Engineer to insure the completion of the improvements set forth on the pro- posed plans and to include the completion of all items and/or repairs up to the date or dedication on a form to be approved by the Director of Law. Section 2: That the City of North Olmsted agrees that upon completion of said twenty-f our C24) inch sewer line and its acceptance by the City Engineer that it will reimburse the de- velotier at a rate of X8.24 per foot or a total of ~10,53C).72. Section 3: That this Ordinance is hereby determined to be an emergency measure necessary for the preservation of the public health, safety and welfare and suctz emergency exists by virtue of the necessity of giving immediate approval to said improvement plans so that the orderly development of the City may proceed as rapidly as possible.
