A <br />CITY OF NORTH OLMSTED <br />ORDINANCE No. 62 -,~ <br />U <br />Hy _ a ~.,~,..,.~ <br />AN ORDINANCE TO ACCEPT A PROPOSAL OF LIBBY- <br />LEE, INC. FOR SEWER CONSTRUCTION IN WFsST <br />237th STREET, PROVIDING FOR THE PROPER <br />EXECUTIC7N OF THE TERMS THEREOF, AND DECLARING <br />AN EMERGENCY. <br />Wt-IEREAS, Council has heretofore approved <br />for record a plat of the Libby-Lee, Inc. Subdivision prepared <br />and filed by the owners of all the lots and lands abutting on <br />West 237th Street throughout its length as shown on said plat, <br />and in connection therewith it has been agreed and understood <br />that the City of North Olmsted would forthwith be permitted to <br />construct and has thereafter constructed a sanitary sewer line <br />as a part of its municipal sanitary sewerage system in and <br />through said West 23.7th Street for the use of which the abutting <br />lots would be required to pay a fee or charge equivalent to <br />$6.00 per abutting front foot, which charge was to include the <br />installation of service connections from said sewer line to the <br />abutting property line; and <br />WHEREAS, Libby-Lee, Inc. has presented to <br />this Council by letter dated April 13, 1462, a proposal whereby <br />said Libby-Lee, Inc. will undertake to construct such service <br />connections and will be allowed a credit in the amount of the <br />cost of installing the same against the aforesaid tap-in charge <br />of $6.00 per front foot, which proposal Council deems advantageous <br />to the City and has accordingly determined to approve and accept <br />the same. <br />NOW, THEREFORE, BE IT ORDAINED BY the Council <br />of the City of North Olmsted, Ohio: <br />Section is That the proposal of Libby-Lee, Inc. em- <br />bodied in its letter dated April 13, 1962, hereinabove referred <br />to, be and the same is hereby approved and accepted, and the <br />Clerk is hereby directed to file said proposal in the permanent <br />records of the Gity under File No. <br />Section 2: That the Director of Public Service is <br />hereby authorized to permit construction of the 74 service con- <br />nections specified in said proposal and pursuant to the same, <br />such service connections to be constructed in accordance with <br />City specifications and to be subject to inspection and approval <br />of work by the City Engineer, for which inspection service the <br />City shall be reimbursed by Libby-Lee, Inc., and that upon final <br />acceptance by the City Engineer of such construction said ser- <br />vice connections shall become and remain the property of the City <br />of North Olmsted and constitute a part of its sanitary sewerage <br />system. <br />Section 3: That the City will permit the connection of <br />house service lines to said service connections provided the City <br />shall have received from Libby-Lee, Inc., in accordance with the <br />of oresaid proposal, the cash sum of $23,562.00, and if such cash <br />sum shall not have been so paid then no lot abutting upon West <br />237th Street shall be permitted to make such connection and to <br />use the City's sewer therein constructed without first paying <br />to the City a tap-in charge in an amount equal to $6.00 per foot <br />of lot frontage on said street, less the sum 'of $105..00 by way <br />of credit for the cost of installing the service connection to <br />be installed pursuant to this ordinance and the aforesaid proposal. <br /> <br />
