A CITY OF NORTH OLMSTED ORDINANCE No. 62 -,~ U Hy _ a ~.,~,..,.~ AN ORDINANCE TO ACCEPT A PROPOSAL OF LIBBY- LEE, INC. FOR SEWER CONSTRUCTION IN WFsST 237th STREET, PROVIDING FOR THE PROPER EXECUTIC7N OF THE TERMS THEREOF, AND DECLARING AN EMERGENCY. Wt-IEREAS, Council has heretofore approved for record a plat of the Libby-Lee, Inc. Subdivision prepared and filed by the owners of all the lots and lands abutting on West 237th Street throughout its length as shown on said plat, and in connection therewith it has been agreed and understood that the City of North Olmsted would forthwith be permitted to construct and has thereafter constructed a sanitary sewer line as a part of its municipal sanitary sewerage system in and through said West 23.7th Street for the use of which the abutting lots would be required to pay a fee or charge equivalent to $6.00 per abutting front foot, which charge was to include the installation of service connections from said sewer line to the abutting property line; and WHEREAS, Libby-Lee, Inc. has presented to this Council by letter dated April 13, 1462, a proposal whereby said Libby-Lee, Inc. will undertake to construct such service connections and will be allowed a credit in the amount of the cost of installing the same against the aforesaid tap-in charge of $6.00 per front foot, which proposal Council deems advantageous to the City and has accordingly determined to approve and accept the same. NOW, THEREFORE, BE IT ORDAINED BY the Council of the City of North Olmsted, Ohio: Section is That the proposal of Libby-Lee, Inc. em- bodied in its letter dated April 13, 1962, hereinabove referred to, be and the same is hereby approved and accepted, and the Clerk is hereby directed to file said proposal in the permanent records of the Gity under File No. Section 2: That the Director of Public Service is hereby authorized to permit construction of the 74 service con- nections specified in said proposal and pursuant to the same, such service connections to be constructed in accordance with City specifications and to be subject to inspection and approval of work by the City Engineer, for which inspection service the City shall be reimbursed by Libby-Lee, Inc., and that upon final acceptance by the City Engineer of such construction said ser- vice connections shall become and remain the property of the City of North Olmsted and constitute a part of its sanitary sewerage system. Section 3: That the City will permit the connection of house service lines to said service connections provided the City shall have received from Libby-Lee, Inc., in accordance with the of oresaid proposal, the cash sum of $23,562.00, and if such cash sum shall not have been so paid then no lot abutting upon West 237th Street shall be permitted to make such connection and to use the City's sewer therein constructed without first paying to the City a tap-in charge in an amount equal to $6.00 per foot of lot frontage on said street, less the sum 'of $105..00 by way of credit for the cost of installing the service connection to be installed pursuant to this ordinance and the aforesaid proposal.
