<br />CITY OF NORTH OL.MSTED <br />RESfg,UTION No. 62 '" <br /> C~ <br />By ~.. <br />RBSOLUTION REQUIRING THE STATE OF t3EiI0 TO REFER <br />TO THE CITY OF N©RTH OLMSTED ALL R~3QUBSTS FOR <br />PBRMISSION TO CONNECT INTO STORM SEWERS LOCATED <br />IN THE RIGHT OF WAY OF STATE HIGHWAYS WITHIN <br />THE CORPORATE LIMITS OF THE CITY OF NORTH <br />OLMSTED, AND DECLARING AN EMBRGENCY. <br />WHERfiA,S, the City of North Olmsted maintains <br />storm sewers some of which lie within the right of way of <br />various state highways within the corporate limits of the <br />City of North Olmsted; and <br />WHIiREAS, it has been called to the attemtaon of <br />this Gouncil that owners of property contiguous to the rights of <br />way of certain state highways within this City have requested of <br />the State of Ohio - Department of Highways permission to connect <br />into said storm sewers without having first obtained permission <br />for such connection from the City of North Olmsted; and <br />WHEREAS, it is of grave concern to this Council <br />that a storm sewer system be kept under the strict control of <br />the City and while it recognizes that the permission of the State <br />of Ohio is necessary before work of any kind can be done within <br />the limits of a state highway right of way, it believes that <br />the City of North Olmsted alone can and should decade when and <br />where connections to its storm sewer system be made and since <br />it desires to make its position on this point clear to the State <br />of Ohio, <br />NOW, THEREFORE, BE IT RESOLVED by the Council <br />of the City of North Olmsted, State of Ohio: <br />Section 1; That the storm sewers of the Gity of <br />North Olmsted, including any within the right of way of any <br />State highway including limited access highways, are the pramazy <br />responsibility of the City of North Olmsted and no request for <br />permission to connect into said storm sewers be considered by <br />the State of Ohio and that such request be directed to the City <br />of North Olmsted. <br />Section 2. That a certified copy of this Resolution <br />be mailed by the Clerk of Council to the Director of the Depart- <br />ment of Highways of the State of Ohio. <br />Section 3: That this is an emergency measure necessary <br />for the preservation of the public health, safety and welfare of <br />the City of North Olmsted especially by virtue of the fact that <br />it concerns the use of the city's storm sewers which are alreadq <br />inadequate for the city's drainage system. <br />
