,.~~, <br /> <br />CITY OF NORTH OLMSTED <br />RESOLUTION No. 62-~,~ <br />ay ~> . ~.~ar~~ <br />RESOLUTION DECLARING THR NECESSITY OF IMPROVING <br />DECKER ROAD FROM THE SOt1TH8RLY LINE OF SU$LOT <br />39b SOUTHERLY TO 3tA1THBRN AVENUE BY CONSTRUCTING <br />THEREIN A STORM SEWER, AND DECLARING AN BMERGENCY. <br />WHEREAS, the owners of more than sixty per <br />cent (60%) of the front footage of property on Decker Road from <br />the southerly line of Subiot 396 to Southern Avenue have <br />petitioned in writing for the improvement of said street by <br />constructing therein a storm sewer and,have in said petition <br />agreed to be assessed for the entire soffit of constructing said <br />storm sewer; and <br />WHEREAS, the Engineer of the City of North <br />Olmsted has certified to the validity of the signatures on said <br />petition as representing the owners of more than sixty per cent <br />(60~a~ of the front footage of property abutting on said pro- <br />posed improvement. <br />NOW, THEREFORE, BE IT RESOLVED by the Council <br />of the City of North Olmsted, Ohio: <br />Section 1: That it is hereby determined to be necessary <br />and conducive to the public health, convenience and welfare of <br />the City of North Olmsted to construct and install a storm sewer <br />and appurtenances thereto on Decker Road in the City of North <br />Olmsted, Ohio, as shown on the plans prepared by the I'uigineer <br />of this City for such improvement, reference to which plans is <br />hereby made. <br />Section ~t That the grade of said street as improved <br />shall be the existing grade as shown by the Engineer's plans and <br />profiles which are made a part hereof and the grade therein <br />established is hereby confirmed as the established grade. <br />Section 3: That the plans, specifications, estimates <br />and profiles of the proposed improvement heretof ore prepared by <br />the Engineer and now on file in the off ice of the Director of <br />Public Service be and the same are hereby approved. <br />Section 4: That the entire cost of said improvement shall <br />be assessed by the front foot upon the f oilowing described lots <br />and lands to-wit: All lots and lands bounding and abutting upon <br />the proposed improvement, which said lots and lands are hereby de- <br />termined to be specifically benefited by said improvement; and <br />the cost of said improvement shall include the expense of the pre- <br />liminary and other surveys and of printing and publishing notices, <br />the cost of construction together with interest on notes and bonds <br />issued in anticipation of the collection of def erred assessments <br />and ali other necessary expenditures. <br />Section 5: That the assessments to be so levied shall <br />be paid in ten (10) annual installments with interest on de- <br />ferred payments at the same rate as shall be borne by the bonds <br />to be issued in anticipation of the collection thereof; provided <br />that the owner of any property assessed may, at his option, pay <br />such assessment in cash within thirty (30) days after the passage <br />of the assessing ordinance. <br />v. ~~ .., ..,.. , _ _ __..,,,.:~. .,. ,, .... <br />
