1 <br />a <br />By ix-~rc- <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 62 .':.,.~~-'' <br />A RESOLUTION RBiQUIRING THE STATE OF OHIO TO <br />REFER TO THE CITY OF NORTH OLMSTBD ALL REQUESTS <br />FOR PERMISSION TO CONNECT INTO STORM SEWER UNDER <br />LIMITED ACCESS HIGHWAY NO. 17 WITHIN THB COR- <br />PORATE LIMTTS OF THE CITY OF NORTH OLMSTED, ANT} <br />DECLARING AN EMERGENCY. <br />WI~fEREAS, the City of North O1~ted, .Ohio <br />maintains a storm sewer box culvert) which for part of its <br />length lies within the right of way of Ohio State Route No. <br />17 talso known as Brookpark Road) designated as a limited access <br />highway in that portion of said Route which lies within the <br />corporate limits of the City of North Olmsted; and <br />WHEREAS, by Ordinance 1979 enacted May ~, <br />1954, the City of North Olmsted agreed to permit the State of <br />Ohio to use said storm sewer to drain Route 17 and in the same <br />Ordinance agreed to maintain and control said highway within the <br />corporate limits of the City of North Olmsted as a limited access <br />highway; and <br />WHEREAS, it has been called to the attention <br />of this Council that owners of properties contiguous to the right <br />of way of said Route i7 have requested of the State of Ohio - De- <br />partment of Highways permission to connect into said storm. sewer <br />without having first obtained permission for such a connection from <br />the City of North Olmsted; and <br />WHEREAS, the State of Ohio has asked for and <br />received consent from the City of North Olmsted in Ordinance No. <br />enacted March 20, 1962 to make preliminary surveys for <br />proposed Interstate Route No. 80 and has indicated that the pro- <br />bable right of way for said Interstate Route 80 will be approximately <br />three hundred (300) feet wide and para11e1 to and contiguous to <br />the present right of way of State Route No. 17 on the easterly side <br />thereof and such a location would necessitate extensive re-planning <br />of a storm sewer system and the re-location of drainage facilities <br />in that area; and <br />WHEREAS, it is of grave concern to this Council <br />that its storm sewer system be kept under the strict control of <br />the City, and while it recognises that the permission of the State <br />of Ohio is necessary before work of any kind can be done within <br />the limits of a State Highway right of way, it believes that the <br />City of North Olmsted alone can and should decide when and where <br />connections to its storm sewer system be made and since it desires <br />to make its position on this point clear to the State of Ohio <br />Nt~t, THEREFORE, BE IT RESOLVED BY the Council <br />of the City of North Olmsted, State of Ohio: <br />Section is That the storm sewers of the City of North <br />Olmsted, including any within the right of way of any State Highway <br />including any limited access highways, are the primary responsibility <br />of the City of North Olmsted and no request for permission to con- <br />nect into said storm sewers be considered by the State of Ohio and <br />that such request be directed if received to the City of North Olmsted. <br />~...~,~~., .,~~ ,~~.~wA~,,:..~~.~~~_~~.~.,~:~~ ~ ~,. <br />
