_ 71-14 7 <br />r _ 2 _ <br />k. In easemen.ts along the south side of Lorain Road from <br />Charles Avenue northeasterly a distance of 284 feet. <br />1. In easements from a point on Barton Road approximately <br />358 feet north of the centerline of Lorain Road, thence <br />southwesterl.y and southerly a distance of 1209 feet to <br />a point on the north side of Lora,in Road which is 400 <br />feet vaest of Cha.rles Avenue. <br />m. Sn easements :Prom a point on $arton Road approximately <br />445 feet north of the centerline of Lorain Road? thence <br />northeasterly 916 feet, thence southeasterly 118 feet, <br />thence northeasterly and apprQximately 326 feet north <br />of Lorain Road a distance of 1010 feet. <br />as reported to this Council on the 7th day of December, 1971, by Floyd G. Browne <br />& Associates, Inc., Consulting En.gineexs to this City, and now on file in the <br />oFfice of the Clerk of Council, be and the same are hereby adopted and confirmed <br />and tha.t there be and are.hereby levied and assessed upon the lots and lands set <br />? fort-h in said list of final assessments the several amounts reported as aforesaid, <br />which assessments are in proportion to the special benefits and are not in excess <br />of any statutory limitation. <br />Seetion 2. That the assessment agai.nst each lot or parcel of land shall be <br />payable in cash?within thirty days after the passage of this ordinance or at the <br />option of the awner in twenty annu.a,l or forty semi-annual installments w.i.th in- <br />terest at the same rate as shall be borne by the bonds to be issued in anticipa- <br />tion of the collection of the same. All cash payments shall be made to the <br />Director of Finance of this City. All assessments and instal.lments thereof re- <br />maining unpaid at the expiration of said thirty days shall be certified by the <br />Clerk of Council to the County Auditor as provided by la,w to be pla.ced by him on <br />the tax duplicate and collected as other taxes are collected. <br />Section 3. That the Clerk of Council sha11 cause a notice of the passage <br />of this ordinance to be published once in a newspaper of general circulation in <br />this City and to continue on file in his oi'fice said revised assessments. <br />Seetion 4. The Clerk of Council is hereby directed to deliver a certified <br />copy of this ordinance to the County Auditor within twenty days after its passage. <br />Section 5. This ordinance is hereby declaxed to be an emergency measure <br />necessary for the immediate preservation of the public peace, health and safety <br />of said City and for the further reason that the immediate levy of such assess- <br />ments is necessary to permit the issuance of bonds to provide funds to retire <br />outstanding notes and thereby protect the credit of the City; wherefore, this <br />ordinance shall be in full force and effect from and immediately after its passage <br />and approval by the Mayor. <br />Passed; <br />Attest; <br />Nora T.
