CITY OF NOR.TH OLMSTED <br />? <br />BY: <br />ORDINANCE N0. 70-31 <br />AN ORDINANCE LEVYING SPECIAL ASSESSI`'?ENTS FOR THE <br />IME'ROVENIENT OF PORTER ROAD AND CERTAIN OTHER <br />STREETS AND PUBLIC EASEMENTS BY CONSTRUCTITdG <br />SANITARY SEWERS, SEWER CURB CONNEGTIONS AAID <br />NECESSARY APPURTENANCES, TIJCLUDING NEG'ESSARY <br />STREET RESURFACING A.ND RESTORATION OF DRAIN- <br />ACE FACILITIES (CONTRACT N0. 11-ZONE 2), AND <br />DECLARING AN EMERGENG`Y. <br />BE IT ORDAIIVED by the Council of the City of Plorth Olmsted, Cuyahoga <br />County, Ohio: <br />; Section 1. That the revised assessments in the aggregate amount of <br />? 139,759.60 to pay -the property owners` .portion of the cost and expense <br />of i.mprovirig the following streets and public easements within the City of <br />North Olmsted by constructing sanitary sewers, sewer curb connections and <br />. necessary appurtenances, includirig necessary street resurfacing and restora- <br />tion of drainage facili-ties: <br />a. Porter Road from a point 548 feet northwesterly <br />of Martin Drive, thence southeasterly 548 feet <br />to Martin Drive; <br />b. Marti.n Drive from'Porter Road to a point 560 feet <br />south of Jenkins Road; <br />c: Jenkins Road from 14artin Drive westerly 485 feet, <br />thence southerly and westerly in a public easement <br />559 feet to Lansing Drive; <br />d. Lansing Drive from a point 880 feet north of Oring <br />Road, thence southerly 2728 feet to North Park <br />Drive; <br />e. North Park Drive from Lansing Drive westerly 439 <br />feet, thence southerly in a public easement 282 <br />feet to the junction ma.nhole adjacent to the exist- <br />ing sewage treatment plant now servi.ng the Sherwood <br />Estates Division; <br />f. Ori.ng Road from Lansing Drive easterly 931 feet to <br />an existing manhole on the existing sewer from the <br />North Park Estates Subdivision; <br />as reported -to -uhis Council on thc 3rd day of :Februarv , 1970) <br />by Floyd G. Browne & Associates, Inc., Consulting Engineers to this City, <br />and now on file in the office ot' the Clerk of Council, be and the same are <br />hereby adopted and confirmed azzd that there be and are hereby levied and <br />assessed upon the lots and lands bounding and abutting u,pon said ixnprovement <br />the several amounts reported as aforesaid, which assessments are in proportion <br />to the special benefits arid are riot in excess of any s-tatutory limitatio.n. <br />Section 2. That the assessment agai.nst each lot or parcel of land <br />shall be ,payable in casti within t;hirty days after the passage of this ordinance <br />? or at the option of the owner in -twexity annual or forty semi-annual install- <br />ments with interest at"the same rate as shall be borne by the bonds to be <br />issued in anticipation of the collection of the same. All cash payments shall <br />be made to the Director of Finance of this City. Al1 assessments and install- <br />ments thereof remaining unpaid at the expiration of said thirty days shall be <br />certified by the Clerk of Council to the County Auditor as provided by law to <br />be placed by him on the ta.x duplicate and collected as other taxes are <br />collected. <br />
