That.the plans, specifications, estimates and profiles for <br />such irriprovernent zr.odifiecl in accordance with Resolution Pio. n;;° /a--; adopted <br />November 6, 1SW and now on file in the office of the Clerk of this Council, <br />are hereby approved and such impxovement sha1Z be made in accordance therewith <br />and in accordance with the provisions of Resolution No. 65-142 passed on <br />September 3, 1968. <br />Section 3. Thalu all clairis for d.amages resulting therefrom that have <br />been legally f7.led shall be inquired into before the corur_encement of the <br />proposed improvement, and the Director of Law is hereby authorized and directed <br />to institute legal proceedings in a court of competent jurisdiction to inqui.re <br />into claims that have been so filed. <br />Section 4. That, subject to the provisio.ns of Section 5 hereof, the <br />portion of the cost provided in the above mentioned resolution of necessity <br />to be assessed shall be assessed in the manner and tlie number of installments <br />provided in said resolution and on the lots and la.nds described therein. <br />Sec'uion 5. That the estimated assessments for such irnprovement hereto- <br />fore prepared by F'loyd G. Browne and Associates, Ltd., Consulting Engineers <br />to this City, ana filea in the office of the Clerk of Council and as equalized <br />by the Assessment Equalization Board heretofore appointed for such purpose <br />by Resolution PTo. 68-164, adopted October 15, 1968, the report of which <br />Board was approved by Resolution Tdo. ?- I?', adopted November 6, 1968, <br />be and the same are hereby aciopted, are in proportion to the benefits which <br />may result from such improvement and are not in excess of any statutory <br />limitation. The reduction of $2,165.96 in the estimated assessments recommended <br />by the Assessr.ient Equalization Board and not attributable to the elimination <br />of sewer curb connections shall be assu.ried by the City in addition to that <br />portion of the cost ox such improvement which the City is req.uired to pay <br />under the provisians of the above-mentioned resolution of necessity. <br />? Section 6. The Clerk of Council is hereby directed to deliver a <br />certified copy o#' this ordinance to the County Auditor within fifteen days <br />after its passage. <br />Section 7. Subject to the provisions of Section 727.24, Revised <br />Code, the Mayor oF the City is hereby authorized and directed as soon as the <br />funds therefor are available to make and execute a contract for said improvement <br />with the lowest a,nd best bidder after advertising according to 1aw and the <br />improvement shall be financed as provided in the resolution of necessity. <br />; ?
