OAAZZ? <br />RESOLUTION N0. ky-1?` <br />A RESOLUTION APPftOVING ZHE REPORT OF THE ASSESSMENT <br />EQUALIZATION BOAI3D ON OBJECTIONS CONCERNING THE <br />ESTIMA7.'ED ASSESSMENTS FOR THE INiPROVEMENT OF CERTAIN <br />STREETS AATD PUBLIC EASEMENTS BY CONSTRUCTING SANITAR.Y <br />SEWERS, SEWER CURB CONNECTIONS AND PIECESSARY APPUR7ENANCES, <br />INCLUDING NECESSARY STREET RESURFACING .AND RESTORATION <br />OF DRAIlVAGE FACILITIES (CONTiBACT N0. 12--ZONE 2), ANp <br />DECLARING AN EMCRGENCY. <br />. <br />1,4HEREAS, the Assessment Equalization Board heretofore appointed by <br />Resolution No. 68-164 of this Council passed October 15, 1968, to hear and <br />determine all objections concerning the estima,ted assessments for the <br />improvement otf Dover Center Road and other streets and easements between <br />the texmini set forth in Resolution No. 68-142, adopted September 3, 1968, <br />(Sewer Contract No. 12) by constructing sanitary sewers, sewer curb <br />connections a,nd necessary appurtenances, including necessary street re- <br />surfacing and restoration of drainage facilities, has filed its report <br />with this Council as to its determination of such objections; and <br />WHEREAS, Council deems such report proper in all respects; <br />NOW,, THEREFORE., BE IT RESOLVED by the Council of the City of <br />North 01msted, Cuyahoga Cpunty, Ohio: <br />Section l. The report of the Assessment Equalization Board <br />hereinbefore recited be and the same is hereby a,pproved. <br />Section 2. That Floyd G. Browne and Associates, Ltd., Consulting <br />Engineers to this City, are hereby authorized and directed to modify the <br />plans, specifications, estimates of cost, profiles and list of estimated <br />assessments for such improvement so as to eliminate the sewer curb <br />connections referred to in such report and to accomplish the assessment <br />reductions that such Board has recommended and the estimated assessments <br />as so modified are hereby directed to be filed in the office of the Clerk <br />of Council. <br />Section 3. That the amount by which the original estimated assess- <br />ments were reduced by the Assessment Equalization Board, other than the <br />amount attributable to the elimination of sewer curb connectians in <br />accordance with such report, shall be assumed by the City in addition to <br />the portion of the cost of the improvement which the City is required to <br />bear under Resolution No. 68-142. - <br />Section 4. This resolution is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, health <br />and safety of said City, a,nd for the further reason that the immediate <br />construction of said improvement is necessary to protect the health of the <br />abutting owners and the inYiabitants of the City; wherefore, this resolution <br />shall be in i'ull force and effect from and immediately after its passage <br />and•approvai, <br />PASSED • <br />ATTEcz') <br />Florence Iiolm, <br />Clerk of Council <br />APpROVED : <br />ti <br />alp E.
