Cecil, widow and not remarried - Permanent <br />Parcel No. 232-31-3 <br />The easement is further described as being over and through <br />a parcel of land ten (10) feet in width, the centerline of <br />which begins at a point on the south line of the above des- <br />dribed permanent parcel, this point being west a distance of <br />914 feet from the centerline of Root Road; thence in a <br />northerly direction for a distance of 158.5 feet to a point <br />on the north line of said permanent parcel, this point <br />being west a distance of 906 feet from the centerline of <br />Root Road as shown on the attached drawing No. N-21. <br />A temporary easement over two parcels of land, each twenty <br />(20) feet in width and 158.5 feet in length located on the <br />' east and west sides of the above described permanent ease- <br />ment is hereby granted for the period of time required to <br />construct the sewer through this property. <br />for the purpose of constructing, maintaining, operating, repairing, <br />altering, replacing, charlgingthe size and removing a sewer together <br />with the necessary manholes for the transportation of sewage with the <br />right of unimpaired access to said sewer and the right of ingress and <br />egress on, over and through said parcels of land for all purposes <br />necessary and incidental to the construction, operation, maintenance, <br />repair,y altering, replacement, changing the size and removal of said <br />sewer. There shall be reserved to the owners of the said parcels of <br />land the right to fully use and enjoy said premises for all purposes <br />consistent with the full use and enjoyment by the City of the easement <br />rights herein described, but the construction of structures as defined <br />in the Building Code of the City of North Olmsted directly over any <br />said sewer, except public utilities, is prohibited. It is a further <br />condition on the said easement rights that the City return the surface <br />of the ground to its original level and general condition after any <br />construction, maintenance, operation, repair, replacement, alteration, <br />changing the size of or removal of said sewer. <br />Section 2: That the Mayor be and he is hereby authorized <br />and directed to cause written notice of the passage of this Resolution <br />to be given to the owners of or persons in possession of or persons <br />having an interest of record in the aliove described real estate or to <br />their authorized agents and said notice shall be served according to <br />law by a person to be designated for that purpose by the Mayor and to <br />make return of such service in the manner prQvided by law. <br />Section 3: This Resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />public health and safety of this City and for the further reason that <br />i.t is necessary to have this Resolution effective immediately in order <br />that the City proceed with the construction of the sewer presently in <br />procees thus contributing to the greater health and comfort of the <br />inhabitants of this City. WHEREFORE, this Resolution shall take effect <br />and be in force immediately upon its passage, otherwise, at the earliest <br />period allowed by law. <br />PASSED:`" /,.
