CITY OF NORTH OLMS'1'ED <br />RESOLUTION N0. ?""' <br />BY <br />A RESOLUTION DECLARING IT NECESSARY TO IMPROVE <br />SOUTF3ERN AVENUE,, DECKER ROAD AND MIDVALE AVENUE <br />IN THE CITY OF NORTH OLMSTED,, OHIO., BY GRADING, <br />DRAINING, CURBING? PAVING) CONSTRUCTING SIDEWALKS? <br />AND INSTALLING SANITARY SEWER, STORM SEWER AND <br />WATER CURB CONIVECTIONS WHERE NECESSARY, REPEALING <br />RESOLUTION N0. 67-133, ANID DECLARING AN EMERGENGY. <br />WHEIiEAS, this Council on June 6, 1967, adoptecl Resolution No. 67-133 <br />declaring the necessity of t;he improvement herein described; and <br />4JHEREAS, the estimate of cost for said improvement approved by <br />Resolution No. 67-133 was subsequently revised and Council deems it necessary <br />to adopt a new resolution declaring the n.ecessity of the improvement described <br />in Section 1 hereof in view of the filing of a new estimate of cost; <br />` NOW, TH.REFORE?'BE IT RESOLVID by the Council of the City of North <br />Olmsted, Cuyahoga County, Ohio, three-fourths of all members elected thereto <br />concurring: <br />' Section l. That it is necessary to improve Southern Avenue from <br />a point 140 west of the westerly line of Decker Road easterly to Burns Road, <br />Decker Road from Southern Avenue to Midvale Avenue, and Midvale Ave.nue from <br />Decker Rvad to Burns Road by grading, draining, curbing;, paving, constructing <br />sidewalks, and installing sanitary sewer, storm sewer and water curb con.nec- <br />tions where necessary, as shown on the plans hereinafter referred to and now <br />on file in the office of the Clerk of Council. <br />Section 2. It is hereby determined and declared that said improve- <br />ment is conducive to the public health, convenience and welfare of said City <br />and the inhabitants thereof. It is hereby further determined that said <br />streets are so situated in relation to each other that in order to complete <br />the improvement thereof in the most practical and economical manner they <br />should be improved at the sa.rre time, with the same kind of materials., and in <br />the same manner, and shall therefore be treated as a single improvement in <br />accordance with Revised Code Section 727.09. <br />Section 3. That the grade of said streets and improvement shall <br />be the grade as shown by the plans and profiles which are made a part hereof. <br />Section 4. That the plans, specifications, esti.mates and profiles <br />of the proposed improvement, heretofore prepared and now on file in the office <br />of the C1erk of Council are hereby approved. <br />Section 5. That the whole cost of said improvement, less at least <br />2% thereof and the cost of intersections, shall be assessed in proportion to <br />the benefits which may result from the improvement upon the following described <br />lots and lands, to wit: <br />? Al1 lots a.nd lands bounding and abutting upon the proposed improve- <br />ment between the termini aforesaid, which said lots and lands are hereby <br />determined to be specially benefited by said i.mprovement; and the cost of <br />said improvement sha11 include the cost of prelixninary and other surveys, <br />plans., specifica-tio.ns, profiles and estimates and of printing, serving and <br />publishi.ng notices, resolutions and ordinances, the amount of damages resulting <br />from the improvement assessed in favor of any owner of land affected by the <br />i.mprovement and the interest thereon, the costs incurred in connection with <br />; ?.. <br />
