? <br />? <br />. <br />_ 2 _ <br /> <br />Section 7. That Richard A. Labas & Associates, Consulting Engineers, <br />be a,nd they are hereby authorized and directed to prepare and file in the office <br />of t he Clerk of this Council the estimated assessments of the cost of the im- <br />provement described in this resolution. Such estirnated assessments shall be <br />based upon the estimate of cost of said improvement now on file in the office <br />of the Clerk of this Couneil and shall be prepared pursuant to the provisions <br />of this resolution. No notice of the adoption of this resolution and the <br />f iling of said estimated assessments need be served on the owner of the lots <br />` and lands to be assessed as provided in R.C. §727•13 for the reason that the <br />petition for said improvement signed by such owner waived service of such <br />notice. <br />Section 8. That the assessments to be levied sha1l be paid in ten <br />? annual installments, with interest on dePerred payments at the same rate as <br />shall be borne by the bonds to be issued in anticipation of the collection <br />thereof; provided, that the oWner of any property assessed may, at his option, <br />pay such assessment in cash within thirty days after passage of the assessing <br />- ordinance. • <br />Section 9. That bonds of the City shall be issued in anticipation <br />of the collection of assessments by installments and in an amount equal there- <br />to and notes of said City shall be issued in anticipation of the issuance of <br />such bonds and the levy of such assessments. <br />Section 10. This resolution is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, health <br />and safety oP said City, and for the ftizrther reason that the immediate con- <br />struction of said improvement is necessary to eliminate existing hazards to <br />pedestrian and vehiculax traffic by providing an additional means of access <br />to the Birch Elementaxy School; wherefore, this resolution shall be in full <br />force and effeet from and immediately after its passage and approval by the <br />Mayor. <br />? ?? t -?.,? <br />PaSSed: ?.?
