TAE CITY OF NOP,TH OLMSTED <br />t,, ORDINANCE N0,67-1? <br />F <br />BY : ?. . <br />AN ORDINANCE LEVYING SPECIAL ASSESSMENTS FOR THE <br />IMPROVEMENT OF SUNSET OVAL AND CERTAIN OTHER STREETS <br />OF THE CITY BY CONSTRUCTING SANITARY SEGTERS, AND <br />DECLARING AN EMFRGENCX. <br />BE IT ORDAINED by the Council of the City of North Olmsted, <br />? Cu_yahoga County, Ohio! <br />Section 1. That the revised assessment of the cost and exnense <br />of improving Sunset Oval, Revere Drive, Pomnton Drive, Gloucester Drive, <br />Maplehurst Road, U?estlawn Drive, Oakdale Drive, Holly Drive, Cypras, <br />? Drive, Elder Drive, Magnolia Drive, Spruce Drive and Aspen Drive by <br />constructing sanitarv sewers and necessary apnurtenances between the <br />termini set f_orth in Resolution No. 65-84, adopted April 6, 1965, amount- <br />ing in the aggregate to $218,417.88, as reported to this Council on the <br />, 3 2 0 day of January, 1967, by Floyd G. Browne & Associates, Ltd., <br />Consulting Engineers of_ this City, and now on file in the o.f_fice of the <br />Clerk of this Council, be and the same is hereby adopted and confirmed and <br />that there by and are hereby levied and assessed unon the lots and lands <br />boundinQ and abutting upon said improvement the several amounts reported <br />as aforesaid, which assessments are in proportion to the special benefits <br />and are hot in excess of'any statutory limitation. <br />Section 2. That this Council hereby finds and determines that <br />the revised assessments as now on file in the office of said Clerk of <br />Council are in the same amount as the original estimated assessments, Council <br />having determined that the Cit_y will assume as part of its share of the cost <br />of the improvement the amount by which the final cost exceeded the original <br />estimated cost of the improvement. <br />N <br />? . <br />Section 3. That the assessment against each lot or parcel of land <br />? shall be payable in cash within thirty days af_ter the passage of this <br />ordinance or at the option of the owner in forty semi-annual installments <br />with interest at the same rate as shall be borne by the bonds to be issued <br />in anticipation of the collection of the same. Al1 cash payments sba.ll be <br />made to the Director of Finance of this City. All assessments and install- <br />ments thereof remaining unpaid at the exniration of said thirty days shall <br />be certified by the Clerk of this Council to the County Auditor as provided <br />? by law to be placed by him on the tax duvlicate and collected as other <br />taxes are collected. <br />? <br />Section 4. That the Clerk of this Council shall cause a notice <br />: of the passape of this ordinance to be published once in a newspaper of <br />general circulation in this City and to contiTiue on file in her office <br />said revised assessments. ? Section 5. The Clerk of this Council is hereby directed to <br />deliver a certified copy of this ordinance to the County Auditor within <br />twenty days after its Passage. <br />Section 6. This ordinance is hereby declared to be an emerQency <br />measure necessary for the immediate preservation of the public peace, health <br />and safety of said City and for the further reason that the immediate levy <br />of such assessments is necessary to permit bonds to be issued to fund an <br />outstanding note of_ the City and thereby preserve the credit of the City, <br />GTIIEREFORE this ordinance shall be in full force and effect from and after <br />its passage and approval by the Mayor. <br />PASSED: <br />T <br />; rncis-J0NeP <br />r sident of.
