CITY OF NORTH OLMSTED RESOLUTION NO. 65-4;?0 Page 2 A temporary easement as shawn on the attached plat marked Exhibit A attached hereto and made a part hereof for the period of time required to construct the sewer thnough this property. Parcel C- Carl Strekely and Helen F. Strekely, husband and wife - Permanent Parcel #234-20-10 The easement is further described as being over and through a parcel of land fifteen (15) feet in width and approximately 105 feet in length located parallel and adjacent to the south right-of-way line of Lorain Road and extending from the easterly line of Permanent Parcel No. 234-20-10 to the westerly line of said Permanent Parcel. A temporary easement iwenty (20) feet in width and approximately 105 feet in length located parallel and adjacent to the south side of the above described permanent easement is hereby granted for the period of time required to construct the sewer through this property. for the purpose of constructing, maintaining, operating, repairing, altering, replacing, changing the size and removing a sewer together with the necessary manholes for the transportation of sewage with the right of unimpaired access to said sewer and the riqht of ingress and egress on, over and through said parcels of land for all purposes necessary and incidental to the construction, operation, maintenance, repair, altering, replacement, changing the size end removal of said sewer. There shall be reserved to the owners of the said parcels of land the right to fully use and enjoy said premises for all purposes consistent with the full use and enjoyment by the City of the easement rights herein described, but the construction of structures as defined in the Building Code of the City of North Olmsted directly over any said sewery except public utilities, is prohibited. It is a further condition on the said easement rights that the City return the surface of the ground to its original level and general condition after any construction, maintenance, operation, repair, replacement alteration, changing the size of or removal of said sewer. Section 2: That the Mayor be and he is hereby authorized and directed to cause written notice of the passage of this Resolution to be given to the owners of or persons in possession of or persons having an interest of record in the above described real estate or to their authorized agents and said notice shall be seived according to law by a person to be designated for that purpose by the Mayor and to make return of such service in the manner provided by law. Section 3: This Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public health and safety of this City and for the futther reason that it is necessary to have this Resolution effective immediately in order that the City proceed with the constrfwtion of the sewer presently in process thus contributing to the qreater health and comfort of the inhabitants of this City. WHEREFORE, this Ordinance shall take effect and be in force immediately upon its passage, otherwise, at the earliest period allowed by law. PASSED: - ?_ ?
