CITY OF NORTH OLMSTED RESOLUTION NO. 65-4;?0 Page 2 <br />A temporary easement as shawn on the attached plat marked <br />Exhibit A attached hereto and made a part hereof for the period <br />of time required to construct the sewer thnough this property. <br />Parcel C- Carl Strekely and Helen F. Strekely, husband and <br />wife - Permanent Parcel #234-20-10 <br />The easement is further described as being over and through a <br />parcel of land fifteen (15) feet in width and approximately <br />105 feet in length located parallel and adjacent to the south <br />right-of-way line of Lorain Road and extending from the <br />easterly line of Permanent Parcel No. 234-20-10 to the westerly <br />line of said Permanent Parcel. <br />A temporary easement iwenty (20) feet in width and <br />approximately 105 feet in length located parallel and <br />adjacent to the south side of the above described permanent <br />easement is hereby granted for the period of time required <br />to construct the sewer through this property. <br />for the purpose of constructing, maintaining, operating, repairing, altering, <br />replacing, changing the size and removing a sewer together with the necessary <br />manholes for the transportation of sewage with the right of unimpaired access <br />to said sewer and the riqht of ingress and egress on, over and through said <br />parcels of land for all purposes necessary and incidental to the construction, <br />operation, maintenance, repair, altering, replacement, changing the size end <br />removal of said sewer. There shall be reserved to the owners of the said <br />parcels of land the right to fully use and enjoy said premises for all purposes <br />consistent with the full use and enjoyment by the City of the easement rights <br />herein described, but the construction of structures as defined in the Building <br />Code of the City of North Olmsted directly over any said sewery except public <br />utilities, is prohibited. It is a further condition on the said easement rights <br />that the City return the surface of the ground to its original level and general <br />condition after any construction, maintenance, operation, repair, replacement <br />alteration, changing the size of or removal of said sewer. <br />Section 2: That the Mayor be and he is hereby authorized and <br />directed to cause written notice of the passage of this Resolution to be given <br />to the owners of or persons in possession of or persons having an interest of <br />record in the above described real estate or to their authorized agents and <br />said notice shall be seived according to law by a person to be designated for <br />that purpose by the Mayor and to make return of such service in the manner <br />provided by law. <br /> <br />Section 3: This Resolution is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public health and <br />safety of this City and for the futther reason that it is necessary to have this <br />Resolution effective immediately in order that the City proceed with the <br />constrfwtion of the sewer presently in process thus contributing to the qreater <br />health and comfort of the inhabitants of this City. WHEREFORE, this Ordinance <br />shall take effect and be in force immediately upon its passage, otherwise, at <br />the earliest period allowed by law. <br />PASSED: - ?_ <br />?
