CITY OF NORTH OLMSTED <br />RESOLUTION NO. 3 0 <br />BY I-LL-l r ? <br />A RESOLUTION DECLARING THE INTE[JT TO APPROPRIATE <br />AND TO TAKE IMMEDIATE POSSESSIOIJ OF PROPERTY <br />NECESSARY FOR THE ZONE THREE SEWER PROGR.AM OF <br />THE CITY OF NORTH OLMSTED, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS; the Council of the City of North Olmsted has <br />heretofore found it necessary to construct sewers within the City of North <br />Olmsted, and <br />WHEREAS, in order to construct the Zone Three Sewer <br />Program it is necessary that the City of North Olmsted acquire temporary <br />easements and in order to maintain the sewers after construction it is <br />necessary to acquire permanent easemerts in certain lands within the City <br />of North Olmsted, and <br />WHEREAS, it is necessary and advisable, for the public <br />health and safety, to take immediate possession of property required for the <br />construction and maintenance of the Zone Three Sewer Program of the <br />City of North Olmsted. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of North Olmsted, State of Ohio: <br />Section 1. That it is deemed necessary to appropriate for <br />a period of Five hundred sixty days (560) an easement in and to the real <br />property, hereinafter described, for the purpose of constructing sanitary <br />sewers in the Zone Three Sewer Proqram of the City of North Olmsted, <br />State of Ohio. <br />The property of Anthony Novak and Lydia S. Novak <br />6369 Barton Road, North Olmsted, Ohio <br />Description of a temporary right-of-way and easement <br />to be granted for a periodof Five hundred sixty days <br />(560) the time required to construct the sewer through <br />the following described property. <br />Q Situated in the City of North Olmsted, County of Cuyahdga, <br />State of Ohio, and known as being part of original Olmsted <br />Township Lot No. 8, Tract No. 6, bounded as follows: <br />Beginning at a point in the centerline of Barton Road, <br />distant South 1° West, 135 feet from an iron pin set at <br />an angle in the new centerline of Barton Road, as <br />shown in Vol. K, Page 3, of Cuyahoga County Records, <br />from which angle point the intersection of the new <br />centerline of Barton Road with the centerline of Lorain <br />Road bears North 490 43' West a distance of 263.98 feet.
