CITY OF N ORTH OLM STE D <br />RESOLUTION N O. 64 --!JL <br />BY <br />A RESOLUTIC)N AUTHORIZING THE DIRECTOR OF PUBLIC <br />SERVICE AND PUBLIC SAFETY TO INSTALL CULVERT PIPE <br />tN THE DRAINAGE D[TCH ON THE WEST SIDE OF CYPRUS <br />DRNE FROM THE LOT KNOWN AS 6574 CYPRUS DRNE <br />SQUTH TO THE CITY LIMITS„ ' <br />WHEREAS, the property ownera on the West side of Cypnis <br />DRive have indicated to council that they desire to have the open drainage <br />ditch ?I'O'•': ho'=::e number 6574 Cyprus Drive south to the southern limits of <br />±he Ci+.y of N: or*.h Olmsted covered aver, and <br />VYHEREAS, the said property o'N?ners have indicated that they <br />will ourchase culvert pipe to place in said drainage ditch, and <br />WHEREAS, the said property owner$ have also aqreed to <br />±umish easements to the C3ty of North Olmsted for the maintenance of said <br />-irainage ditch after said drainage ditch has been covered over, and <br />WHEREAS, Council f in an effort to maintain a sanitary and <br />healty condition within the City o i$° e di?tcheseclosedhover haso greed t ith <br />any residents desiring to have dra 9 <br />furnish the labor for the installation of the culvertpipe . <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />o# North Olmsted: State of Ohio: <br />Section 1: That the Dlrector of Public Secvice and Publfc <br />Safety is hereby authorized to furnish the labor for the closinq of the drainaqe <br />ditcr which runs through the property located on the West side of Gyprus Drive <br />or conditior that the homeowners furnish to the City of North Olmsted a perpetual <br />easement fo* the maintenance of said ditch, and further on condition that the <br />propectv awners pay for the cost of said poWeK pipe needed to enclose said <br />ditch. <br />Section 2: That this Resolutfon is hereby declared to be an I <br />emergencv measure necessary fo!' the prese bat of the faict thattsaid o?pen <br />and safety o` the citizens of Nortti Olmsted Y virtue in the area, <br />drainage ditch creates an unhealthy condition for the property ?ners ; <br />WuEREFORE, this resolution shall take effect immedi+etely upon its passage end ; <br />approti?al by ±he mayor o±henn?i se ; fmm and after the earliest period allowed by law. ? <br />to PASaED:_ ?? <br />? ? <br />ATTEST; <br />Maraaret T.
