<br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 64- <br />BY+ <br />A RESOLUTION ACCEPTING A DRAINAGE EASEMENT <br />THROUGH THE PROPERTY OWNED BY FREDRICK <br />• HOMER MARCIS. <br />WHEREAS, the City of North Olmsted has maintained a drainage <br />ditch through the property owned by Fredrick Homer Marcis, and <br />WHEREAS, the City wishes to place drainage pipe in said <br />ditch and to cover said ditch, and <br />WHEREAS, the City wishes to have a right to enter $aid <br />property for the purposes of repairing or maintaining said drainage pipe. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of North Olmsted, State of Ohio: <br />• Section 1: That the Council does hereby accept an easement <br />from Fredrick Homer Marcis for the installation and maintenance of drainage <br />pipe through the property of Fredrick Homer Marcis; the cost of the drainage <br />pipe is to be borne by Fredrick Homer Marcis on condition that the City of <br />North Olmsted will install same. <br />Section 2: That this Resolution is hereby declared to be <br />. an emergency measure necessary for the preservation of the public health <br />and welfare of the City by virtue of the fact that said open ditch constitutes <br />a health hazaad; WHEREFORE, this Resolution shall be in force and take effect <br />immediately upon its passage, otherwise, at the earliest period allowed by <br />1 aw . <br />PASSED: <br />Francis J.
