<br />CITY OF NORTH OLMSTED ? <br />ORDINANCE NO. 65-a ?,r <br />BY <br />AN ORDINANCE AMENDING ORDINANCE NO. 65-8, <br />ENACTED JANUARY 19, 1965, BIING "AN ORDIIVANCE <br />AUTHORtZING THE ACCEPTANCE BY THE CITY OF AN <br />EASEMENT OVER THE PROPERTY OF jOE HOISLBAUER, <br />A.K.A. JOSEPH BAUER, AND MARGARET HOISLBAUER, <br />FOR USE IN CONNECTION WITH THE EASEMENTS <br />LOCATED IN THE BEVERLY HILLS PARK ESTATES SUB- <br />? DIVISION NO. 2, AREA NO. 3, AND DECLARING AN <br />EMERGENCY",AND DECLARING AN EMERGENCY <br />WHEREAS, by the above Ordinance Council approved the <br />acceptance of an easement from Joe Hoislbauer, a. k, a. Joseph Bauer <br />and Margaret Hoislbauer; and <br />WHEREAS, Council has since been advised that Bauer <br />Development, Inc. also has an irterest in:the land to which the easement <br />is granted; and <br />WHEREAS, Council now wishes to correct the aforesaid <br />Ordinance. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City <br />of IVorth Olmsted, State of Ohio: <br />Section 1: That Section 1 of Ordinance No. 65-8 reading as <br />follows: <br />"Section 1: That this Council hereby determined that it is <br />necessary in connection with the construction of a sanitary sewer in <br />Area No. 3 in the City of North Olmsted to accept from Joe Hoislbauer, <br />a.k.a. Joseph Bauer, and Margaret Hoislbauer Easements No. 1, No. 2, <br />No. 3, and No. 4 over parts of their lands, parts of which shall be <br />permanent easements for the installation and maintenance of sanitary <br />sewers and part of which shall be temporary easements for construction <br />purposes, all of which easements are described in detail by metes and <br />bounds in the attached easement which is made a part hereof by <br />reference.
