That all claims Por damages resulting therefrom that have <br />been legally filed shall be inquired into after the completion of the pro- <br />posed improvement, and the Director of I,aw is hereby authorized and directed <br />to institute legal proceedings in a court of competent jurisdiction to inquire <br />into claims that have been so filed. <br />Section 4. That portion of the cost provided in the above-mentioned <br />resolution of necessity to be assessed shall be assessed in the manner and <br />? the number of`installments provided in said resolution and on the lots and <br />lands described therein. <br />Section 5. `?'hat the estimated assessments heretofore prepsred by <br />Floyd G. Brown & Associates, Ltd., Consulting Ecigineers, and Piled in the <br />office of the !;lerk of this Council, as equalized by the .lssessment <br />Equalization Board appointed by Resolution No. 65-112 adopted June 1, 1965, <br />the report of which board was approved by Resolution No. S-/4 adopted <br />1965, be and the same are hereby approved, and this Council <br />hereby agrees to asstxme the amount by which the original estimated assessments <br />aere reduced. <br />Seciion b. The Clerk of this Council is hereby directed to deliver a <br />certified cop.v :)f this ordinance to the County Auditor within fifteen days <br />after its passage. <br />Section 7• Sub?ect to the provisions of Sectior, 727.24, Revised Code, <br />the Ma.yor is hereby alithoriz?d and directed as ;-,oon as the fund.s therefor <br />are available to make and execute acontract for said impro•remer.t with the <br />lowest and best bidder after adve:-tisinF; according to law and the improvement <br />shall be finanrPd as provided in the resoi.ution of necessity. <br />Section ?3.
