r <br />W <br />? <br />CITY rJF NORTH OLMSTED <br />RESOLUTION NO. 65 <br />? <br />BY <br />A RES LUTTON AUTHORIZING THE SAFETY SERVICE <br />DIRECTOR TO ENTER INTO NEGOTIATIGNS FOR THE <br />PURCHASE UF REAL PROPERTY AND OF AUTHORIZING <br />THE MAYOR TO SIGN ALL NECESSARY DOCUMENTS <br />IN ORDER TO EFFEGTUATE SUCH PURCHASE AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the City of Narth Olmsted has entered into a <br />?sewer program involving the securing of easements through various parcels <br />of real estate in the City of Narth Olmsted; and <br />WHEREAS, in order to secure the aforesaid easements <br />through real property, it may became necessary ta acquire said easements <br />by Eminent Domain Proceedings; and <br />WHEREAS, the sewer program within the City af North <br />Glmsted is of ali emergency nature in order to provide sewer facilities to the <br />residents of the City of North Olmsted; and <br />WHEREAS, :n some instances it is more eronomical to <br />purchase the real estate than it is to secure an easement; and <br />WHEREAS, in order to assist the North Qlmsted sewer <br />program, Area 3, tile Council of the City of North Olmsted has been advised <br />that the property iocated at 5871 Fitch Road in the City of North Olr.risted can <br />be purchased at a lawer price than the Pasement through said proper±y, <br />Counci.l has now decided to purchase the aforesaid rFal property. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of North <br />Olmsted, State o? (-)rio; <br />Section l; Tha± the Safety Service I?irPctor of t'ile City <br />of IVTorth Olmsted is authorized to ente:- in*o negotiations *c purchase the <br />property at 5871 Fitr.,h Road and owned by Emma S. Fretter, widow and not <br />re-married, for apurchase price not to exceed $: 8,000.00, -Lighteen <br />Thousar7d Dollars. <br />Section 2: That upon the conclusion of the negotiatians <br />and the purchase af this property, if said property is purcnased, the Mayor <br />of the Gity of North Olmsied is hereby authorized to sign arzy corttracts, <br />accept any deeds of canveYance ner_essary to effect;.,ate the acquirirzg ci <br />the aforesaid ;-eal praper':y by the C,ity o:` North Olmsted. <br />Sec*ion 3: That this Reso?utiori is hereby declar-ed to be <br />? an emerqency nleasure, necessary tor the preservation of the ptrblic peace, <br />health, welfare and safe'.y o` the reside;its af ?,Jorth Olmsted by vir'ue of the <br />fact that this property is necessary to continue Area 3 sewe;s without delaying <br />the contractcr and the entire se:ver prograTn: 11,'T-3ERFFORE, This F'esolution shall <br />take effect and be ir force immediately upor, i*s passac;e, atlherwise at the <br />earliest period ailowed by law. -?-y-:----" <br />'_ <br />PA SSEI3: <br />ATTEST,?.,. a-z , President of Council <br />.. .
